7 | 7 | | less than 21 years of age may purchase a firearm; creating a |
---|
8 | 8 | | criminal offense. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 46.06, Penal Code, is amended by amending |
---|
11 | 11 | | Subsections (a), (c), and (d) and adding Subsection (c-1) to read as |
---|
12 | 12 | | follow: |
---|
13 | 13 | | (a)A person commits an offense if the person: |
---|
14 | 14 | | (1) sells, rents, leases, loans, or gives a handgun to |
---|
15 | 15 | | any person knowing that the person to whom the handgun is to be |
---|
16 | 16 | | delivered intends to use it unlawfully or in the commission of an |
---|
17 | 17 | | unlawful act; |
---|
18 | 18 | | (2) intentionally or knowingly sells, rents, leases, or |
---|
19 | 19 | | gives or offers to sell, rent, lease, or give: |
---|
20 | 20 | | (A) a to any child younger than 18 years of age any |
---|
21 | 21 | | [firearm,] club, or location-restricted knife; or |
---|
22 | 22 | | (B) a firearm to any person younger than 21 years |
---|
23 | 23 | | of age before a 30-day waiting period has elapsed from the date of |
---|
24 | 24 | | transfer. |
---|
25 | 25 | | (3) intentionally, knowingly, or recklessly sells a |
---|
26 | 26 | | firearm or ammunition for a firearm to any person who is |
---|
27 | 27 | | intoxicated; |
---|
28 | 28 | | (4) knowingly sells a firearm or ammunition for a |
---|
29 | 29 | | firearm to any person who has been convicted of a felony before the |
---|
30 | 30 | | fifth anniversary of the later of the following dates: |
---|
31 | 31 | | (A) the person 's release from confinement |
---|
32 | 32 | | following conviction of the felony; or |
---|
33 | 33 | | (B) the person's release from supervision under |
---|
34 | 34 | | community supervision, parole, or mandatory supervision following |
---|
35 | 35 | | conviction of the felony; |
---|
36 | 36 | | (5) sells, rents, leases, loans, or gives a handgun to |
---|
37 | 37 | | any person knowing that an active protective order is directed to |
---|
38 | 38 | | the person to whom the handgun is to be delivered; |
---|
39 | 39 | | (6) knowingly purchases, rents, leases, or receives as |
---|
40 | 40 | | a loan or gift from another a handgun while an active protective |
---|
41 | 41 | | order is directed to the actor; or |
---|
42 | 42 | | (7) while prohibited from possessing a firearm under |
---|
43 | 43 | | state or federal law, knowingly makes a material false statement on |
---|
44 | 44 | | a form that is: |
---|
45 | 45 | | (A) required by state or federal law for the |
---|
46 | 46 | | purchase, sale, or other transfer of a firearm; and |
---|
47 | 47 | | (B) submitted to a [licensed] firearms dealer |
---|
48 | 48 | | licensed under [, as defined by] 18 U.S.C. Section 923. |
---|
49 | 49 | | (c) It is an affirmative defense to prosecution under |
---|
50 | 50 | | Subsection (a)(2)(A) [(a)(2)] that the transfer was to a minor |
---|
51 | 51 | | whose parent or the person having legal custody of the minor had |
---|
52 | 52 | | given written permission for the sale or, if the transfer was other |
---|
53 | 53 | | than a sale, the parent or person having legal custody had given |
---|
54 | 54 | | effective consent. |
---|
55 | 55 | | (c-1) It is a defense to prosecution under Subsection |
---|
56 | 56 | | (a)(2)(B) that the transfer was to a person who provided evidence to |
---|
57 | 57 | | the actor that the person is: |
---|
58 | 58 | | (1) a peace officer; or |
---|
59 | 59 | | (2) a member of the armed forces or state military |
---|
60 | 60 | | forces as defined by Section 431.001, Government Code. |
---|
61 | 61 | | (d) An offense under this section is a Class A misdemeanor, |
---|
62 | 62 | | except that: |
---|
63 | 63 | | (1) an offense under Subsection (a)(2)(A) [(a)(2)] is a state |
---|
64 | 64 | | jail felony if the weapon that is the subject of the offense is a |
---|
65 | 65 | | handgun; [and] |
---|
66 | 66 | | (2) an offense under Subsection (a)(2)(B) is a state jail |
---|
67 | 67 | | felony; and |
---|
68 | 68 | | (3) an offense under Subsection (a)(7) is a state jail |
---|
69 | 69 | | felony. |
---|
70 | 70 | | SECTION 2. Chapter 46, Penal Code, is amended Section 46.16 |
---|
71 | 71 | | to read as follows: |
---|
72 | 72 | | Sec. 46.16. WAITING PERIOD FOR FIREARMS TRANSFER. (a) No |
---|
73 | 73 | | licensed firearms dealer shall sell or transfer a firearm to a |
---|
74 | 74 | | purchaser younger than 21 years of age unless a 30-day waiting |
---|
75 | 75 | | period has elapsed from the date of the transfer. |
---|
76 | 76 | | (b) The 30-day waiting period under this section shall not |
---|
77 | 77 | | apply to any sale or transfer of a firearm: |
---|
78 | 78 | | (i) Made to a law enforcement officer, a member of the |
---|
79 | 79 | | armed forces, or a firearms instructor; or |
---|
80 | 80 | | (ii) Made as part of a lawful bequest or intestate |
---|
81 | 81 | | succession. |
---|
82 | 82 | | (c) Any person who violates the provisions of this statute |
---|
83 | 83 | | shall be guilty of a Class A misdemeanor. |
---|
84 | 84 | | SECTION 3. This Act takes effect September 1, 2023. |
