| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter N, Chapter 2301, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 2301.655 to read as follows: |
|---|
| 12 | 12 | | Sec. 2301.655. VEHICLE MONITORING TECHNOLOGY. (a) In this |
|---|
| 13 | 13 | | section: |
|---|
| 14 | 14 | | (1) "Light truck" and "passenger car" have the |
|---|
| 15 | 15 | | meanings assigned by Section 541.201, Transportation Code. |
|---|
| 16 | 16 | | (2) "Vehicle monitoring technology" means any |
|---|
| 17 | 17 | | application or device, including software, firmware, or hardware, |
|---|
| 18 | 18 | | that, when activated or engaged, monitors the operator or operation |
|---|
| 19 | 19 | | of a motor vehicle on which it is installed. |
|---|
| 20 | 20 | | (b) The board may take an action described by Section |
|---|
| 21 | 21 | | 2301.651 against a license holder under this chapter who: |
|---|
| 22 | 22 | | (1) manufactures, distributes, or possesses with |
|---|
| 23 | 23 | | intent to distribute vehicle monitoring technology that is: |
|---|
| 24 | 24 | | (A) installed or intended to be installed on a |
|---|
| 25 | 25 | | light truck or passenger car; and |
|---|
| 26 | 26 | | (B) not capable of being deactivated or |
|---|
| 27 | 27 | | disengaged by the vehicle's operator; |
|---|
| 28 | 28 | | (2) installs on a light truck or passenger car vehicle |
|---|
| 29 | 29 | | monitoring technology that is not capable of being deactivated or |
|---|
| 30 | 30 | | disengaged by the vehicle's operator; or |
|---|
| 31 | 31 | | (3) sells a light truck or passenger car on which has |
|---|
| 32 | 32 | | been installed vehicle monitoring technology that is not capable of |
|---|
| 33 | 33 | | being deactivated or disengaged by the vehicle's operator. |
|---|
| 34 | 34 | | SECTION 2. Section 2301.655, Occupations Code, as added by |
|---|
| 35 | 35 | | this Act, applies only to disciplinary action under Section |
|---|
| 36 | 36 | | 2301.651, Occupations Code, against a license holder for conduct |
|---|
| 37 | 37 | | that occurs on or after the effective date of this Act. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
