66 AN ACT
77 relating to vehicle monitoring technology installed on certain
88 motor vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter N, Chapter 2301, Occupations Code, is
1111 amended by adding Section 2301.655 to read as follows:
1212 Sec. 2301.655. VEHICLE MONITORING TECHNOLOGY. (a) In this
1313 section:
1414 (1) "Light truck" and "passenger car" have the
1515 meanings assigned by Section 541.201, Transportation Code.
1616 (2) "Vehicle monitoring technology" means any
1717 application or device, including software, firmware, or hardware,
1818 that, when activated or engaged, monitors the operator or operation
1919 of a motor vehicle on which it is installed.
2020 (b) The board may take an action described by Section
2121 2301.651 against a license holder under this chapter who:
2222 (1) manufactures, distributes, or possesses with
2323 intent to distribute vehicle monitoring technology that is:
2424 (A) installed or intended to be installed on a
2525 light truck or passenger car; and
2626 (B) not capable of being deactivated or
2727 disengaged by the vehicle's operator;
2828 (2) installs on a light truck or passenger car vehicle
2929 monitoring technology that is not capable of being deactivated or
3030 disengaged by the vehicle's operator; or
3131 (3) sells a light truck or passenger car on which has
3232 been installed vehicle monitoring technology that is not capable of
3333 being deactivated or disengaged by the vehicle's operator.
3434 SECTION 2. Section 2301.655, Occupations Code, as added by
3535 this Act, applies only to disciplinary action under Section
3636 2301.651, Occupations Code, against a license holder for conduct
3737 that occurs on or after the effective date of this Act.
3838 SECTION 3. This Act takes effect September 1, 2023.
