55 relating to legislative leave for certain peace officers

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
99 Code, is amended by adding Section 11.0183 to read as follows:
1010 Sec. 11.0183. DONATION OF ACCRUED COMPENSATORY TIME OR
1111 ACCRUED ANNUAL LEAVE FOR LEGISLATIVE PURPOSES. (a) The director
1212 shall allow a peace officer commissioned by the department to
1313 voluntarily transfer to a legislative leave pool up to eight hours
1414 of compensatory time or annual leave per year earned by the peace
1515 officer.
1616 (b) The director or the director's designee shall
1717 administer the legislative leave pool.
1818 (c) The commission shall adopt rules and prescribe
1919 procedures relating to the operation of the legislative leave pool.
2020 (d) The director or the director's designee shall credit the
2121 legislative leave pool with the amount of time contributed by a
2222 peace officer commissioned by the department and deduct a
2323 corresponding amount of time from the peace officer's earned
2424 compensatory time or annual leave as if the peace officer had used
2525 the time for personal purposes.
2626 (e) A peace officer commissioned by the department is
2727 entitled to use time contributed to the legislative leave pool if
2828 the peace officer uses the time for legislative leave on behalf of a
2929 law enforcement association:
3030 (1) related to the peace officer's employment with the
3131 department;
3232 (2) that has at least 150 active or retired members;
3333 and
3434 (3) that is governed by a board of directors.
3535 (f) The director or the director's designee shall transfer
3636 time from the pool to the peace officer and credit the time to the
3737 peace officer.
3838 (g) A peace officer commissioned by the department may only
3939 withdraw time from the legislative leave pool in coordination with
4040 and with the consent of the president or designee of the law
4141 enforcement association described in Subsection (e). A peace
4242 officer may not draw more than 80 hours from the pool in a 160-hour
4343 work cycle and may not draw more than 480 hours from the pool in a
4444 fiscal year.
4545 (h) A peace officer commissioned by the department shall use
4646 time from the legislative leave pool in accordance with rules
4747 adopted by the commission.
4848 SECTION 2. This Act takes effect September 1, 2023.
