44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the declaration of a candidate's ineligibility and to
77 the prohibition of the candidate's placement on the ballot.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 145.003, Election Code, is amended by
1010 amending Subsection (f) and adding Subsection (f-1) to read as
1111 follows:
1212 (f) A candidate may be declared ineligible only if:
1313 (1) the information on the candidate's application for
1414 a place on the ballot indicates that the candidate is ineligible for
1515 the office; [or]
1616 (2) facts indicating that the candidate is ineligible
1717 are conclusively established by another public record; or
1818 (3) the candidate fails to pay the filing fee or submit
1919 a petition in lieu of a filing fee that satisfies the requirements
2020 prescribed by Section 141.062.
2121 (f-1) The authority responsible for preparing the ballots
2222 shall omit a candidate from the ballot if the candidate is declared
2323 ineligible under Subsection (f).
2424 SECTION 2. This Act takes effect September 1, 2023.
