6 | 6 | | relating to the declaration of a candidate's ineligibility and to |

7 | 7 | | the prohibition of the candidate's placement on the ballot. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 145.003, Election Code, is amended by |
---|
10 | 10 | | amending Subsection (f) and adding Subsection (f-1) to read as |
---|
11 | 11 | | follows: |
---|
12 | 12 | | (f) A candidate may be declared ineligible only if: |
---|
13 | 13 | | (1) the information on the candidate's application for |
---|
14 | 14 | | a place on the ballot indicates that the candidate is ineligible for |
---|
15 | 15 | | the office; [or] |
---|
16 | 16 | | (2) facts indicating that the candidate is ineligible |
---|
17 | 17 | | are conclusively established by another public record; or |
---|
18 | 18 | | (3) the candidate fails to pay the filing fee or submit |
---|
19 | 19 | | a petition in lieu of a filing fee that satisfies the requirements |
---|
20 | 20 | | prescribed by Section 141.062. |
---|
21 | 21 | | (f-1) The authority responsible for preparing the ballots |
---|
22 | 22 | | shall omit a candidate from the ballot if the candidate is declared |
---|
23 | 23 | | ineligible under Subsection (f). |
---|
24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
