55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain agreements with collective bargaining
88 organizations related to certain publicly funded public work
99 contracts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 51.7761(b), Education Code, is amended
1212 to read as follows:
1313 (b) An institution awarding a public work contract funded
1414 in whole or in part with state or local governmental money or
1515 governmentally administered financial assistance, including the
1616 issuance of debt guaranteed by this state or a local governmental
1717 entity, money from ratepayers, or money from user fees, may not:
1818 (1) prohibit, require, discourage, or encourage a
1919 person bidding on the public work contract, including a contractor
2020 or subcontractor, from entering into or adhering to an agreement
2121 with a collective bargaining organization relating to the project;
2222 or
2323 (2) discriminate against a person described by
2424 Subdivision (1) based on the person's involvement in the agreement,
2525 including the person's:
2626 (A) status or lack of status as a party to the
2727 agreement; or
2828 (B) willingness or refusal to enter into the
2929 agreement.
3030 SECTION 2. Section 2269.0541(a), Government Code, is
3131 amended to read as follows:
3232 (a) A governmental entity awarding a public work contract
3333 funded in whole or in part with state or local governmental money or
3434 governmentally administered financial assistance, including the
3535 issuance of debt guaranteed by this state or a local governmental
3636 entity, money from ratepayers, or money from user fees, may not:
3737 (1) prohibit, require, discourage, or encourage a
3838 person bidding on the public work contract, including a contractor
3939 or subcontractor, from entering into or adhering to an agreement
4040 with a collective bargaining organization relating to the project;
4141 or
4242 (2) discriminate against a person described by
4343 Subdivision (1) based on the person's involvement in the agreement,
4444 including the person's:
4545 (A) status or lack of status as a party to the
4646 agreement; or
4747 (B) willingness or refusal to enter into the
4848 agreement.
4949 SECTION 3. The changes made by this Act to Section 51.7761,
5050 Education Code, and Section 2269.0541, Government Code, apply only
5151 to a public work contract for which an invitation for offers,
5252 request for proposals, request for qualifications, or other similar
5353 solicitation is first published or distributed on or after the
5454 effective date of this Act. A public work contract for which an
5555 invitation for offers, request for proposals, request for
5656 qualifications, or other similar solicitation is first published or
5757 distributed before the effective date of this Act is governed by the
5858 law in effect at the time the invitation, request, or other
5959 solicitation is published or distributed, and the former law is
6060 continued in effect for that purpose.
6161 SECTION 4. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2023.
