44 AN ACT
55 relating to the issuance by certain conservation and reclamation
66 districts of bonds for the development and maintenance of
77 recreational facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 49.4645(a), Water Code, is amended to
1010 read as follows:
1111 (a) A district all or part of which is located in Bastrop
1212 County, Bexar County, Waller County, Travis County, Williamson
1313 County, Harris County, Galveston County, Brazoria County,
1414 Montgomery County, El Paso County, or Fort Bend County may issue
1515 bonds supported by ad valorem taxes to pay for the development and
1616 maintenance of recreational facilities only if the bonds are
1717 authorized by a majority vote of the voters of the district voting
1818 in an election held for that purpose. Except as provided by
1919 Subsection (a-1), the outstanding principal amount of bonds, notes,
2020 and other obligations issued to finance [parks and] recreational
2121 facilities supported by ad valorem taxes may not exceed an amount
2222 equal to one percent of the value of the taxable property in the
2323 district as shown by the tax rolls of the central appraisal district
2424 at the time of the issuance of the bonds, notes, and other
2525 obligations. To establish the value of the taxable property in a
2626 district under this section, the district may use an estimate of the
2727 value provided by the central appraisal district. The district may
2828 not issue bonds supported by ad valorem taxes to pay for the
2929 development and maintenance of:
3030 (1) indoor or outdoor swimming pools; or
3131 (2) golf courses.
3232 SECTION 2. This Act takes effect on the date on which the
3333 constitutional amendment proposed by the 88th Legislature, Regular
3434 Session, 2023, relating to the authority of the legislature to
3535 permit conservation and reclamation districts in El Paso County to
3636 issue bonds supported by ad valorem taxes to fund the development
3737 and maintenance of parks and recreational facilities is approved by
3838 the voters. If that amendment is not approved by the voters, this
3939 Act has no effect.
