| 5 | 5 | | relating to the issuance by certain conservation and reclamation |

| 6 | 6 | | districts of bonds for the development and maintenance of |
|---|
| 7 | 7 | | recreational facilities. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 9 | 9 | | SECTION 1. Section 49.4645(a), Water Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (a) A district all or part of which is located in Bastrop |
|---|
| 12 | 12 | | County, Bexar County, Waller County, Travis County, Williamson |
|---|
| 13 | 13 | | County, Harris County, Galveston County, Brazoria County, |
|---|
| 14 | 14 | | Montgomery County, El Paso County, or Fort Bend County may issue |
|---|
| 15 | 15 | | bonds supported by ad valorem taxes to pay for the development and |
|---|
| 16 | 16 | | maintenance of recreational facilities only if the bonds are |
|---|
| 17 | 17 | | authorized by a majority vote of the voters of the district voting |
|---|
| 18 | 18 | | in an election held for that purpose. Except as provided by |
|---|
| 19 | 19 | | Subsection (a-1), the outstanding principal amount of bonds, notes, |
|---|
| 20 | 20 | | and other obligations issued to finance [parks and] recreational |
|---|
| 21 | 21 | | facilities supported by ad valorem taxes may not exceed an amount |
|---|
| 22 | 22 | | equal to one percent of the value of the taxable property in the |
|---|
| 23 | 23 | | district as shown by the tax rolls of the central appraisal district |
|---|
| 24 | 24 | | at the time of the issuance of the bonds, notes, and other |
|---|
| 25 | 25 | | obligations. To establish the value of the taxable property in a |
|---|
| 26 | 26 | | district under this section, the district may use an estimate of the |
|---|
| 27 | 27 | | value provided by the central appraisal district. The district may |
|---|
| 28 | 28 | | not issue bonds supported by ad valorem taxes to pay for the |
|---|
| 29 | 29 | | development and maintenance of: |
|---|
| 30 | 30 | | (1) indoor or outdoor swimming pools; or |
|---|
| 31 | 31 | | (2) golf courses. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect on the date on which the |
|---|
| 33 | 33 | | constitutional amendment proposed by the 88th Legislature, Regular |
|---|
| 34 | 34 | | Session, 2023, relating to the authority of the legislature to |
|---|
| 35 | 35 | | permit conservation and reclamation districts in El Paso County to |
|---|
| 36 | 36 | | issue bonds supported by ad valorem taxes to fund the development |
|---|
| 37 | 37 | | and maintenance of parks and recreational facilities is approved by |
|---|
| 38 | 38 | | the voters. If that amendment is not approved by the voters, this |
|---|
| 39 | 39 | | Act has no effect. |
