44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the disclosure of certain health care cost information
77 by certain health care facilities; authorizing an administrative
88 penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 327.001(7), Health and Safety Code, is
1111 amended to read as follows:
1212 (7) "Facility" means a hospital, freestanding
1313 emergency medical care facility, urgent care or retail clinic,
1414 outpatient clinic, birthing center, ambulatory surgical center, or
1515 other facility that is licensed to provide health care services in
1616 this state [licensed under Chapter 241].
1717 SECTION 2. Section 327.008(a), Health and Safety Code, is
1818 amended to read as follows:
1919 (a) The commission may impose an administrative penalty on a
2020 facility [in accordance with Chapter 241] if the facility fails to:
2121 (1) respond to the commission's request to submit a
2222 corrective action plan; or
2323 (2) comply with the requirements of a corrective
2424 action plan submitted to the commission.
2525 SECTION 3. A health care facility required to disclose
2626 billing information under Chapter 327, Health and Safety Code, as
2727 amended by this Act, shall disclose the information in accordance
2828 with that chapter not later than August 31, 2027.
2929 SECTION 4. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
