| 6 | 6 | | relating to the disclosure of certain health care cost information |

| 7 | 7 | | by certain health care facilities; authorizing an administrative |
|---|
| 8 | 8 | | penalty. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 327.001(7), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (7) "Facility" means a hospital, freestanding |
|---|
| 13 | 13 | | emergency medical care facility, urgent care or retail clinic, |
|---|
| 14 | 14 | | outpatient clinic, birthing center, ambulatory surgical center, or |
|---|
| 15 | 15 | | other facility that is licensed to provide health care services in |
|---|
| 16 | 16 | | this state [licensed under Chapter 241]. |

| 17 | 17 | | SECTION 2. Section 327.008(a), Health and Safety Code, is |
|---|
| 18 | 18 | | amended to read as follows: |
|---|
| 19 | 19 | | (a) The commission may impose an administrative penalty on a |
|---|
| 20 | 20 | | facility [in accordance with Chapter 241] if the facility fails to: |
|---|
| 21 | 21 | | (1) respond to the commission's request to submit a |
|---|
| 22 | 22 | | corrective action plan; or |
|---|
| 23 | 23 | | (2) comply with the requirements of a corrective |
|---|
| 24 | 24 | | action plan submitted to the commission. |
|---|
| 25 | 25 | | SECTION 3. A health care facility required to disclose |
|---|
| 26 | 26 | | billing information under Chapter 327, Health and Safety Code, as |
|---|
| 27 | 27 | | amended by this Act, shall disclose the information in accordance |
|---|
| 28 | 28 | | with that chapter not later than August 31, 2027. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
