55 relating to repealing the coordinated strategic plan for health and
66 human services in this state, including related conforming
77 amendments.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 531.024(a), Government Code, is amended
1010 to read as follows:
1111 (a) The executive commissioner shall:
1212 (1) facilitate and enforce coordinated planning and
1313 delivery of health and human services, including:
1414 (A) [compliance with the coordinated strategic
1515 plan;
1616 [(B)] co-location of services;
1717 (B) [(C)] integrated intake; and
1818 (C) [(D)] coordinated referral and case
1919 management;
2020 (2) develop with the Department of Information
2121 Resources automation standards for computer systems to enable
2222 health and human services agencies, including agencies operating at
2323 a local level, to share pertinent data;
2424 (3) establish and enforce uniform regional boundaries
2525 for all health and human services agencies;
2626 (4) carry out statewide health and human services
2727 needs surveys and forecasting;
2828 (5) perform independent special-outcome evaluations
2929 of health and human services programs and activities;
3030 (6) at the request of a governmental entity that
3131 coordinates the delivery of health and human services in regions,
3232 counties, and municipalities of this state [identified under
3333 Section 531.022(e)], assist the [that] entity in implementing a
3434 coordinated plan that may include co-location of services,
3535 integrated intake, and coordinated referral and case management and
3636 is tailored to the needs and priorities of that entity; and
3737 (7) promulgate uniform fair hearing rules for all
3838 Medicaid-funded services.
3939 SECTION 2. Section 531.028(b), Government Code, is amended
4040 to read as follows:
4141 (b) The executive commissioner shall establish a federal
4242 money management system to coordinate and monitor the use of
4343 federal money that is received by health and human services
4444 agencies to ensure that the money is spent in the most efficient
4545 manner and shall:
4646 (1) establish priorities for use of federal money by
4747 all health and human services agencies[, in coordination with the
4848 coordinated strategic plan established under Section 531.022];
4949 (2) coordinate and monitor the use of federal money
5050 for health and human services to ensure that the money is spent in
5151 the most cost-effective manner throughout the health and human
5252 services system;
5353 (3) review and approve all federal funding plans for
5454 health and human services in this state;
5555 (4) estimate available federal money, including
5656 earned federal money, and monitor unspent money;
5757 (5) ensure that the state meets federal requirements
5858 relating to receipt of federal money for health and human services,
5959 including requirements relating to state matching money and
6060 maintenance of effort;
6161 (6) transfer appropriated amounts as described by
6262 Section 531.0271; and
6363 (7) ensure that each governmental entity that
6464 coordinates the delivery of health and human services in regions,
6565 counties, and municipalities of this state [identified under
6666 Section 531.022(e)] has access to complete and timely information
6767 about all sources of federal money for health and human services
6868 programs and that technical assistance is available to governmental
6969 entities seeking grants of federal money to provide health and
7070 human services.
7171 SECTION 3. Section 533.032(a), Health and Safety Code, is
7272 amended to read as follows:
7373 (a) The department shall have a long-range plan relating to
7474 the provision of services under this title covering at least six
7575 years that includes at least the provisions required by Section
7676 [Sections 531.022 and] 531.023, Government Code, and Chapter 2056,
7777 Government Code. The plan must cover the provision of services in
7878 and policies for state-operated institutions and ensure that the
7979 medical needs of the most medically fragile persons with mental
8080 illness the department serves are met.
8181 SECTION 4. Section 533A.032(a), Health and Safety Code, is
8282 amended to read as follows:
8383 (a) The department shall have a long-range plan relating to
8484 the provision of services under this title covering at least six
8585 years that includes at least the provisions required by Section
8686 [Sections 531.022 and] 531.023, Government Code, and Chapter 2056,
8787 Government Code. The plan must cover the provision of services in
8888 and policies for state-operated institutions and ensure that the
8989 medical needs of the most medically fragile persons with an
9090 intellectual disability the department serves are met.
9191 SECTION 5. Section 40.051, Human Resources Code, is amended
9292 to read as follows:
9393 Sec. 40.051. STRATEGIC PLAN FOR DEPARTMENT. The department
9494 shall develop a departmental strategic plan based on [the goals and
9595 priorities stated in the commission's coordinated strategic plan
9696 for health and human services. The department shall also develop
9797 its plan based on]:
9898 (1) furthering the policy of family preservation;
9999 (2) the goal of ending the abuse and neglect of
100100 children in the conservatorship of the department; and
101101 (3) the goal of increasing the capacity and
102102 availability of foster, relative, and kinship placements in this
103103 state.
104104 SECTION 6. Section 531.022, Government Code, is repealed.
105105 SECTION 7. This Act takes effect September 1, 2023.
