5 | 5 | | relating to repealing the coordinated strategic plan for health and |

6 | 6 | | human services in this state, including related conforming |
---|
7 | 7 | | amendments. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
9 | 9 | | SECTION 1. Section 531.024(a), Government Code, is amended |
---|
10 | 10 | | to read as follows: |
---|
11 | 11 | | (a) The executive commissioner shall: |
---|
12 | 12 | | (1) facilitate and enforce coordinated planning and |
---|
13 | 13 | | delivery of health and human services, including: |
---|
14 | 14 | | (A) [compliance with the coordinated strategic |
---|
15 | 15 | | plan; |
---|
16 | 16 | | [(B)] co-location of services; |
---|
17 | 17 | | (B) [(C)] integrated intake; and |
---|
18 | 18 | | (C) [(D)] coordinated referral and case |
---|
19 | 19 | | management; |
---|
20 | 20 | | (2) develop with the Department of Information |
---|
21 | 21 | | Resources automation standards for computer systems to enable |
---|
22 | 22 | | health and human services agencies, including agencies operating at |
---|
23 | 23 | | a local level, to share pertinent data; |
---|
24 | 24 | | (3) establish and enforce uniform regional boundaries |
---|
25 | 25 | | for all health and human services agencies; |
---|
26 | 26 | | (4) carry out statewide health and human services |
---|
27 | 27 | | needs surveys and forecasting; |
---|
28 | 28 | | (5) perform independent special-outcome evaluations |
---|
29 | 29 | | of health and human services programs and activities; |
---|
30 | 30 | | (6) at the request of a governmental entity that |
---|
31 | 31 | | coordinates the delivery of health and human services in regions, |
---|
32 | 32 | | counties, and municipalities of this state [identified under |
---|
33 | 33 | | Section 531.022(e)], assist the [that] entity in implementing a |
---|
34 | 34 | | coordinated plan that may include co-location of services, |
---|
35 | 35 | | integrated intake, and coordinated referral and case management and |
---|
36 | 36 | | is tailored to the needs and priorities of that entity; and |
---|
37 | 37 | | (7) promulgate uniform fair hearing rules for all |
---|
38 | 38 | | Medicaid-funded services. |
---|
39 | 39 | | SECTION 2. Section 531.028(b), Government Code, is amended |
---|
40 | 40 | | to read as follows: |
---|
41 | 41 | | (b) The executive commissioner shall establish a federal |
---|
42 | 42 | | money management system to coordinate and monitor the use of |
---|
43 | 43 | | federal money that is received by health and human services |
---|
44 | 44 | | agencies to ensure that the money is spent in the most efficient |
---|
45 | 45 | | manner and shall: |
---|
46 | 46 | | (1) establish priorities for use of federal money by |
---|
47 | 47 | | all health and human services agencies[, in coordination with the |
---|
48 | 48 | | coordinated strategic plan established under Section 531.022]; |
---|
49 | 49 | | (2) coordinate and monitor the use of federal money |
---|
50 | 50 | | for health and human services to ensure that the money is spent in |
---|
51 | 51 | | the most cost-effective manner throughout the health and human |
---|
52 | 52 | | services system; |
---|
53 | 53 | | (3) review and approve all federal funding plans for |
---|
54 | 54 | | health and human services in this state; |
---|
55 | 55 | | (4) estimate available federal money, including |
---|
56 | 56 | | earned federal money, and monitor unspent money; |
---|
57 | 57 | | (5) ensure that the state meets federal requirements |
---|
58 | 58 | | relating to receipt of federal money for health and human services, |
---|
59 | 59 | | including requirements relating to state matching money and |
---|
60 | 60 | | maintenance of effort; |
---|
61 | 61 | | (6) transfer appropriated amounts as described by |
---|
62 | 62 | | Section 531.0271; and |
---|
63 | 63 | | (7) ensure that each governmental entity that |
---|
64 | 64 | | coordinates the delivery of health and human services in regions, |
---|
65 | 65 | | counties, and municipalities of this state [identified under |
---|
66 | 66 | | Section 531.022(e)] has access to complete and timely information |
---|
67 | 67 | | about all sources of federal money for health and human services |
---|
68 | 68 | | programs and that technical assistance is available to governmental |
---|
69 | 69 | | entities seeking grants of federal money to provide health and |
---|
70 | 70 | | human services. |
---|
71 | 71 | | SECTION 3. Section 533.032(a), Health and Safety Code, is |
---|
72 | 72 | | amended to read as follows: |
---|
73 | 73 | | (a) The department shall have a long-range plan relating to |
---|
74 | 74 | | the provision of services under this title covering at least six |
---|
75 | 75 | | years that includes at least the provisions required by Section |
---|
76 | 76 | | [Sections 531.022 and] 531.023, Government Code, and Chapter 2056, |
---|
77 | 77 | | Government Code. The plan must cover the provision of services in |
---|
78 | 78 | | and policies for state-operated institutions and ensure that the |
---|
79 | 79 | | medical needs of the most medically fragile persons with mental |
---|
80 | 80 | | illness the department serves are met. |
---|
81 | 81 | | SECTION 4. Section 533A.032(a), Health and Safety Code, is |
---|
82 | 82 | | amended to read as follows: |
---|
83 | 83 | | (a) The department shall have a long-range plan relating to |
---|
84 | 84 | | the provision of services under this title covering at least six |
---|
85 | 85 | | years that includes at least the provisions required by Section |
---|
86 | 86 | | [Sections 531.022 and] 531.023, Government Code, and Chapter 2056, |
---|
87 | 87 | | Government Code. The plan must cover the provision of services in |
---|
88 | 88 | | and policies for state-operated institutions and ensure that the |
---|
89 | 89 | | medical needs of the most medically fragile persons with an |
---|
90 | 90 | | intellectual disability the department serves are met. |
---|
91 | 91 | | SECTION 5. Section 40.051, Human Resources Code, is amended |
---|
92 | 92 | | to read as follows: |
---|
93 | 93 | | Sec. 40.051. STRATEGIC PLAN FOR DEPARTMENT. The department |
---|
94 | 94 | | shall develop a departmental strategic plan based on [the goals and |
---|
95 | 95 | | priorities stated in the commission's coordinated strategic plan |
---|
96 | 96 | | for health and human services. The department shall also develop |
---|
97 | 97 | | its plan based on]: |
---|
98 | 98 | | (1) furthering the policy of family preservation; |
---|
99 | 99 | | (2) the goal of ending the abuse and neglect of |
---|
100 | 100 | | children in the conservatorship of the department; and |
---|
101 | 101 | | (3) the goal of increasing the capacity and |
---|
102 | 102 | | availability of foster, relative, and kinship placements in this |
---|
103 | 103 | | state. |
---|
104 | 104 | | SECTION 6. Section 531.022, Government Code, is repealed. |
---|
105 | 105 | | SECTION 7. This Act takes effect September 1, 2023. |
