| 7 | 7 | | relating to certain prohibited transactions between an |

| 8 | 8 | | open-enrollment charter school and an abortion provider or |

| 9 | 9 | | affiliate of the provider. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2273.001(4), Government Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (4) "Governmental entity" means this state, a state |
|---|
| 14 | 14 | | agency in the executive, judicial, or legislative branch of state |
|---|
| 15 | 15 | | government, [or] a political subdivision of this state, or an |
|---|
| 16 | 16 | | open-enrollment charter school established under Subchapter D, |
|---|
| 17 | 17 | | Chapter 12, Education Code. |
|---|
| 18 | 18 | | SECTION 2. Section 2273.001(4), Government Code, as amended |
|---|
| 19 | 19 | | by this Act, applies only to a taxpayer resource transaction |
|---|
| 20 | 20 | | entered into on or after the effective date of this Act. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2023. |
