| 5 | 5 | | relating to the procedures for the issuance of a personal |

| 6 | 6 | | identification certificate to a person whose driver's license is |
|---|
| 7 | 7 | | surrendered. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 521.101(m), Transportation Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (m) The department shall adopt procedures for the issuance |
|---|
| 12 | 12 | | of a personal identification certificate to a person who surrenders |
|---|
| 13 | 13 | | the person's driver's license at the time of applying for the |
|---|
| 14 | 14 | | certificate. The procedures: |
|---|
| 15 | 15 | | (1) must be in compliance with federal guidelines |
|---|
| 16 | 16 | | governing the issuance of identification documents; |
|---|
| 17 | 17 | | (2) may require the person issued a personal |
|---|
| 18 | 18 | | identification certificate to update information previously |
|---|
| 19 | 19 | | provided to the department under Section 521.142; [and] |
|---|
| 20 | 20 | | (3) except as provided by Subdivision (2), may not |
|---|
| 21 | 21 | | require a person to provide additional identification documents |
|---|
| 22 | 22 | | unless required for compliance with federal guidelines described by |
|---|
| 23 | 23 | | Subdivision (1); and |
|---|
| 24 | 24 | | (4) must require that the person issued a personal |
|---|
| 25 | 25 | | identification certificate be: |
|---|
| 26 | 26 | | (A) notified that the person's voter |
|---|
| 27 | 27 | | registration information will need to be updated to include the |
|---|
| 28 | 28 | | identification number of the newly issued certificate; and |
|---|
| 29 | 29 | | (B) provided an opportunity to update the |
|---|
| 30 | 30 | | person's voter registration information at the time of applying for |
|---|
| 31 | 31 | | the certificate to include the identification number of the newly |
|---|
| 32 | 32 | | issued certificate. |

| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
