55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the TexMesonet Hydrometeorology
88 Network and creation of the TexMesonet Advisory Committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 16.012(b), Water Code, is amended to
1111 read as follows:
1212 (b) The executive administrator shall:
1313 (1) determine suitable locations for future water
1414 facilities, including reservoir sites;
1515 (2) determine suitable, cost-effective water supply
1616 alternatives on a regional basis, including voluntary means of
1717 encouraging aggressive water conservation;
1818 (3) locate land best suited for irrigation;
1919 (4) make estimates of the cost of proposed irrigation
2020 works and the improvement of reservoir sites;
2121 (5) examine and survey reservoir sites;
2222 (6) monitor the effects of fresh water inflows upon
2323 the bays and estuaries of Texas;
2424 (7) monitor instream flows;
2525 (7-a) monitor hydrometeorological conditions;
2626 (8) lead a statewide effort, in coordination with
2727 federal, state, and local governments, institutions of higher
2828 education, and other interested parties, to develop a network for
2929 collecting and disseminating water resource-related information
3030 that is sufficient to support assessment of ambient water
3131 conditions statewide;
3232 (9) make recommendations for optimizing the
3333 efficiency and effectiveness of water resource data collection and
3434 dissemination as necessary to ensure that basic water resource data
3535 are maintained and available for Texas; and
3636 (10) make basic data and summary information developed
3737 under this subsection accessible to state agencies and other
3838 interested persons.
3939 SECTION 2. Subchapter B, Chapter 16, Water Code, is amended
4040 by adding Section 16.026 to read as follows:
4141 Sec. 16.026. TEXMESONET HYDROMETEOROLOGY NETWORK;
4242 TEXMESONET ADVISORY COMMITTEE. (a) In this section, "network"
4343 means the TexMesonet Hydrometeorology Network.
4444 (b) The executive administrator shall establish the
4545 TexMesonet Hydrometeorology Network to provide a statewide
4646 resource for hydrometeorological data and summary information
4747 benefiting weather forecasting, flood preparedness, drought
4848 monitoring, wildfire management, water resources planning, water
4949 conservation, agricultural readiness and productivity, industrial
5050 readiness, and related business readiness and productivity across
5151 this state.
5252 (c) The network shall:
5353 (1) establish a series of stations throughout this
5454 state to monitor hydrometeorological conditions;
5555 (2) coordinate mesoscale, evapotranspiration, and
5656 soil moisture monitoring efforts in this state by:
5757 (A) collecting, receiving, analyzing,
5858 processing, and facilitating access to basic hydrometeorological
5959 data; and
6060 (B) developing and disseminating products,
6161 tools, and summary information related to that data;
6262 (3) serve as the centralized repository for
6363 hydrometeorological data in this state; and
6464 (4) provide appropriate technical assistance related
6565 to the duties described by Subdivisions (1)-(3).
6666 (d) The executive administrator may, on behalf of the
6767 network, enter into:
6868 (1) any agreement with an individual or a federal,
6969 state, or local governmental entity to provide site location and
7070 access for earth observation stations; and
7171 (2) a partnership with a public or private entity to
7272 provide additional funding and resources for improved access to and
7373 development of hydrometeorological data, products, and tools.
7474 (e) Each state agency or political subdivision of this state
7575 that collects hydrometeorological information, including public
7676 institutions of higher education, shall cooperate with the network
7777 in the development of a coordinated, efficient, and effective
7878 statewide hydrometeorological data collection and dissemination
7979 resource.
8080 (f) The executive administrator may establish the
8181 TexMesonet Advisory Committee to advise and make recommendations to
8282 the executive administrator on ensuring data quality and optimizing
8383 the efficiency and effectiveness of hydrometeorological data
8484 collection, product development, and dissemination of data and
8585 information. Chapter 2110, Government Code, does not apply to the
8686 size, composition, or duration of the advisory committee. Members
8787 of the advisory committee serve without compensation but are
8888 entitled to reimbursement for actual or necessary expenses incurred
8989 in performing functions as a member of the advisory committee
9090 subject to any applicable limitation on reimbursement provided by
9191 the General Appropriations Act. The committee may include members
9292 representing the following entities or interest groups:
9393 (1) the office of the state climatologist;
9494 (2) the National Weather Service;
9595 (3) existing hydrometeorological networks; and
9696 (4) other appropriate entities.
9797 SECTION 3. This Act takes effect September 1, 2023.
