7	7	relating to a ballot proposition on the manner of election for
8	8	members of the board of trustees of a school district.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 11.052, Education Code, is amended by
11	11	amending Subsections (a), (b), (d), and (e) and adding Subsections
12	12	(e-1) and (e-2) to read as follows:
13	13	(a) Except as provided by Subsection (b), the board of
14	14	trustees of an independent school district, on its own motion, may
15	15	order that a proposition be placed on the ballot at the next regular
16	16	election of trustees on the question of electing:
17	17	(1) all trustees of the district [are to be elected]
18	18	from single-member trustee districts; or
19	19	(2) [that] not fewer than 70 percent of the [members of
20	20	the board of] trustees [are to be elected] from single-member
21	21	trustee districts with the remaining trustees to be elected from
22	22	the district at large.
23	23	(b) If a majority of the area of an independent school
24	24	district is located in a county with a population of less than
25	25	10,000, the board of trustees of the district, on its own motion,
26	26	may order that a proposition be placed on the ballot at the next
27	27	regular election of trustees on the question of electing:
28	28	(1) all trustees of the district [are to be elected]
29	29	from single-member trustee districts; or
30	30	(2) [that] not fewer than 50 percent of the [members of
31	31	the board of] trustees [are to be elected] from single-member
32	32	trustee districts with the remaining trustees to be elected from
33	33	the district at large.
34	34	(d) An order of the board adopted under Subsection (a) or
35	35	(b) must be entered not later than the 120th day before the date of
36	36	the [first] election at which the ballot proposition to elect some
37	37	or all [all or some] of the trustees [are elected] from
38	38	single-member trustee districts is to be submitted to the voters
39	39	[authorized by the order].
40	40	(e) If at least 15 percent or 15,000 of the registered
41	41	voters of the school district, whichever is less, sign and present
42	42	to the board of trustees a petition requesting submission to the
43	43	voters of the proposition that trustees of the district be elected
44	44	in a specific manner, which must be generally described on the
45	45	petition and which must be a manner of election that the board could
46	46	have proposed [ordered] on its own motion under Subsection (a) or
47	47	(b), the board shall order that the appropriate proposition be
48	48	placed on the ballot at the first regular election of trustees held
49	49	after the 120th day after the date the petition is submitted to the
50	50	board.
51	51	(e-1) A [The] proposition submitted under this section must
52	52	specify the number of trustees to be elected from single-member
53	53	districts.
54	54	(e-2) Beginning with the first regular election of trustees
55	55	held after an election at which a majority of the registered voters
56	56	voting approve a [the] proposition submitted under this section,
57	57	trustees of the district shall be elected in the manner prescribed
58	58	by the approved proposition.
59	59	SECTION 2. This Act takes effect September 1, 2023.
