55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a ballot proposition on the manner of election for
88 members of the board of trustees of a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.052, Education Code, is amended by
1111 amending Subsections (a), (b), (d), and (e) and adding Subsections
1212 (e-1) and (e-2) to read as follows:
1313 (a) Except as provided by Subsection (b), the board of
1414 trustees of an independent school district, on its own motion, may
1515 order that a proposition be placed on the ballot at the next regular
1616 election of trustees on the question of electing:
1717 (1) all trustees of the district [are to be elected]
1818 from single-member trustee districts; or
1919 (2) [that] not fewer than 70 percent of the [members of
2020 the board of] trustees [are to be elected] from single-member
2121 trustee districts with the remaining trustees to be elected from
2222 the district at large.
2323 (b) If a majority of the area of an independent school
2424 district is located in a county with a population of less than
2525 10,000, the board of trustees of the district, on its own motion,
2626 may order that a proposition be placed on the ballot at the next
2727 regular election of trustees on the question of electing:
2828 (1) all trustees of the district [are to be elected]
2929 from single-member trustee districts; or
3030 (2) [that] not fewer than 50 percent of the [members of
3131 the board of] trustees [are to be elected] from single-member
3232 trustee districts with the remaining trustees to be elected from
3333 the district at large.
3434 (d) An order of the board adopted under Subsection (a) or
3535 (b) must be entered not later than the 120th day before the date of
3636 the [first] election at which the ballot proposition to elect some
3737 or all [all or some] of the trustees [are elected] from
3838 single-member trustee districts is to be submitted to the voters
3939 [authorized by the order].
4040 (e) If at least 15 percent or 15,000 of the registered
4141 voters of the school district, whichever is less, sign and present
4242 to the board of trustees a petition requesting submission to the
4343 voters of the proposition that trustees of the district be elected
4444 in a specific manner, which must be generally described on the
4545 petition and which must be a manner of election that the board could
4646 have proposed [ordered] on its own motion under Subsection (a) or
4747 (b), the board shall order that the appropriate proposition be
4848 placed on the ballot at the first regular election of trustees held
4949 after the 120th day after the date the petition is submitted to the
5050 board.
5151 (e-1) A [The] proposition submitted under this section must
5252 specify the number of trustees to be elected from single-member
5353 districts.
5454 (e-2) Beginning with the first regular election of trustees
5555 held after an election at which a majority of the registered voters
5656 voting approve a [the] proposition submitted under this section,
5757 trustees of the district shall be elected in the manner prescribed
5858 by the approved proposition.
5959 SECTION 2. This Act takes effect September 1, 2023.
