55 relating to the requirement that providers of active shooter

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.0812, Education Code, is amended by
1111 adding Subsection (c) to read as follows:
1212 (c) A school district may not contract for the provision of
1313 active shooter response training under this section unless the
1414 training provider is certified under Section 1701.2515,
1515 Occupations Code, to provide the training.
1616 SECTION 2. Subchapter E, Chapter 51, Education Code, is
1717 amended by adding Section 51.221 to read as follows:
1818 Sec. 51.221. ACTIVE SHOOTER TRAINING PROVIDERS. An
1919 institution of higher education, as defined by Section 61.003, may
2020 not contract for the provision of active shooter training for peace
2121 officers commissioned under this subchapter unless the training
2222 provider is certified under Section 1701.2515, Occupations Code, to
2323 provide the training.
2424 SECTION 3. Subchapter F, Chapter 1701, Occupations Code, is
2525 amended by adding Section 1701.2515 to read as follows:
2626 Sec. 1701.2515. CERTIFICATE REQUIRED TO PROVIDE ACTIVE
2727 SHOOTER TRAINING AT PUBLIC SCHOOLS AND INSTITUTIONS OF HIGHER
2828 EDUCATION. (a) In this section, "institution of higher education"
2929 has the meaning assigned by Section 61.003, Education Code.
3030 (b) An individual or a legal entity may not provide active
3131 shooter training to peace officers of students or employees at a
3232 public primary or secondary school or an institution of higher
3333 education unless:
3434 (1) the individual providing the instruction is
3535 certified by the commission under this section to provide the
3636 training; and
3737 (2) if the training is provided by a legal entity, both
3838 the legal entity and the individual providing the instruction on
3939 behalf of the legal entity are certified by the commission under
4040 this section to provide the training.
4141 (c) The commission shall:
4242 (1) establish a certification program for providers of
4343 active shooter training, including for individuals and legal
4444 entities; and
4545 (2) issue a certificate to a provider who meets the
4646 qualifications of the program established under Subdivision (1).
4747 (d) The commission shall adopt rules for the renewal of a
4848 certificate issued under this section. The commission may require
4949 continuing education for the renewal of the certificate.
5050 SECTION 4. Not later than September 1, 2024, the Texas
5151 Commission on Law Enforcement shall establish the certification
5252 program required by Section 1701.2515, Occupations Code, as added
5353 by this Act.
5454 SECTION 5. Sections 37.0812(c) and 51.221, Education Code,
5555 as added by this Act, and Section 1701.2515(b), Occupations Code,
5656 as added by this Act, apply only to active shooter training provided
5757 on or after December 1, 2024.
5858 SECTION 6. This Act takes effect September 1, 2023.
