5	5	relating to the requirement that providers of active shooter
6	6	training at public schools and institutions of higher education
7	7	obtain a certificate issued by the Texas Commission on Law
8	8	Enforcement.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 37.0812, Education Code, is amended by
11	11	adding Subsection (c) to read as follows:
12	12	(c) A school district may not contract for the provision of
13	13	active shooter response training under this section unless the
14	14	training provider is certified under Section 1701.2515,
15	15	Occupations Code, to provide the training.
16	16	SECTION 2. Subchapter E, Chapter 51, Education Code, is
17	17	amended by adding Section 51.221 to read as follows:
18	18	Sec. 51.221. ACTIVE SHOOTER TRAINING PROVIDERS. An
19	19	institution of higher education, as defined by Section 61.003, may
20	20	not contract for the provision of active shooter training for peace
21	21	officers commissioned under this subchapter unless the training
22	22	provider is certified under Section 1701.2515, Occupations Code, to
23	23	provide the training.
24	24	SECTION 3. Subchapter F, Chapter 1701, Occupations Code, is
25	25	amended by adding Section 1701.2515 to read as follows:
26	26	Sec. 1701.2515. CERTIFICATE REQUIRED TO PROVIDE ACTIVE
27	27	SHOOTER TRAINING AT PUBLIC SCHOOLS AND INSTITUTIONS OF HIGHER
28	28	EDUCATION. (a) In this section, "institution of higher education"
29	29	has the meaning assigned by Section 61.003, Education Code.
30	30	(b) An individual or a legal entity may not provide active
31	31	shooter training to peace officers of students or employees at a
32	32	public primary or secondary school or an institution of higher
33	33	education unless:
34	34	(1) the individual providing the instruction is
35	35	certified by the commission under this section to provide the
36	36	training; and
37	37	(2) if the training is provided by a legal entity, both
38	38	the legal entity and the individual providing the instruction on
39	39	behalf of the legal entity are certified by the commission under
40	40	this section to provide the training.
41	41	(c) The commission shall:
42	42	(1) establish a certification program for providers of
43	43	active shooter training, including for individuals and legal
44	44	entities; and
45	45	(2) issue a certificate to a provider who meets the
46	46	qualifications of the program established under Subdivision (1).
47	47	(d) The commission shall adopt rules for the renewal of a
48	48	certificate issued under this section. The commission may require
49	49	continuing education for the renewal of the certificate.
50	50	SECTION 4. Not later than September 1, 2024, the Texas
51	51	Commission on Law Enforcement shall establish the certification
52	52	program required by Section 1701.2515, Occupations Code, as added
53	53	by this Act.
54	54	SECTION 5. Sections 37.0812(c) and 51.221, Education Code,
55	55	as added by this Act, and Section 1701.2515(b), Occupations Code,
56	56	as added by this Act, apply only to active shooter training provided
57	57	on or after December 1, 2024.
58	58	SECTION 6. This Act takes effect September 1, 2023.
