5 | 5 | | WHEREAS, 19 school children were murdered and two teachers at |
---|
6 | 6 | | Robb Elementary in Uvalde, Texas on May 24, 2022, and |
---|
7 | 7 | | WHEREAS, hundreds of law enforcement officials, including at |
---|
8 | 8 | | least 91 Department of Public Safety (DPS) troopers and rangers, |
---|
9 | 9 | | waited 77 minutes before ending the slaughter of innocence while |
---|
10 | 10 | | children and teachers bled out on the floor of their classroom; and |
---|
11 | 11 | | WHEREAS, the failure to intercede on behalf of the injured |
---|
12 | 12 | | and mortally wounded may have led to the death of several children |
---|
13 | 13 | | and, at least, one teacher, and exacerbated the wounds of other |
---|
14 | 14 | | victims; and |
---|
15 | 15 | | WHEREAS, the failure on behalf of the law enforcement |
---|
16 | 16 | | officials, including DPS employees, to adequately and efficiently |
---|
17 | 17 | | care for the wounded may have further aggravated the injuries and |
---|
18 | 18 | | suffering of the victims; now, therefore, be it |
---|
19 | 19 | | RESOLVED, by the Legislature of the State of Texas, That a |
---|
20 | 20 | | student or teacher injured or killed during the attack on Robb |
---|
21 | 21 | | Elementary on May 24, 2022, with a claim based on the conduct or |
---|
22 | 22 | | negligence of a state employee is granted permission to sue the |
---|
23 | 23 | | State of Texas and any of its agencies, departments, bureaus, |
---|
24 | 24 | | boards, commissions, offices, councils, courts, and institutions |
---|
25 | 25 | | of higher education subject to Chapter 107, Civil Practice and |
---|
26 | 26 | | Remedies Code, for damages authorized by law. |
