45 SENATE CONCURRENT RESOLUTION
56 WHEREAS, The Texas Legislature for each of the last 20
67 regular sessions has adopted a concurrent resolution authorizing
78 the creation and appointment of joint legislative study committees
89 by the lieutenant governor and speaker of the House of
910 Representatives; and
1011 WHEREAS, Renewal of the prior authorizations to the presiding
1112 officers enables the legislature to address and study issues that
1213 remain unresolved on sine die adjournment or that emerge subsequent
1314 to that time; and
1415 WHEREAS, It is also desirable to adopt by resolution various
1516 rules and policies regarding the operation of joint committees to
1617 supplement, and reconcile differences between, the Senate and House
1718 rules of procedure; now, therefore, be it
1819 RESOLVED, That the 88th Legislature of the State of Texas
1920 hereby authorize the lieutenant governor and speaker of the House
2021 of Representatives to create by mutual agreement such joint
2122 committees as they consider necessary during the term of this
2223 legislature; and, be it further
2324 RESOLVED, That each joint committee created pursuant to this
2425 resolution be composed of such combination of legislators, state
2526 officials, or citizen members as shall be determined mutually by
2627 the presiding officers of each house; and, be it further
2728 RESOLVED, That on the request of the presiding officers, the
2829 governor may appoint members to a joint committee created pursuant
2930 to this resolution; and, be it further
3031 RESOLVED, That the presiding officers issue for each
3132 committee so created a joint proclamation identifying the issue or
3233 issues to be studied and listing the committee membership or
3334 describing the committee composition and that the proclamation be
3435 filed with the secretary of the Senate and the chief clerk of the
3536 House of Representatives; and, be it further
3637 RESOLVED, That the presiding officers designate jointly a
3738 chair, or designate alternatively two co-chairs, from among the
3839 legislative members of the committee; and, be it further
3940 RESOLVED, That the chair or co-chairs, acting jointly and
4041 within four weeks of the proclamation, prepare and present to the
4142 presiding officers a proposal for budget and staffing; and, be it
4243 further
4344 RESOLVED, That the chair or co-chairs be directed to use to
4445 the greatest extent possible the existing staff and administrative
4546 resources of committee members, standing committees, officers of
4647 the Senate and House, and legislative service agencies; and, be it
4748 further
4849 RESOLVED, That the presiding officers jointly review each
4950 budget and staffing proposal, adopt budgetary and staffing
5051 allocations, and determine the manner in which each joint committee
5152 is to be funded; and, be it further
5253 RESOLVED, That the joint committee chair, or the co-chairs
5354 acting by mutual agreement, have authority to create and appoint
5455 subcommittees or affiliated advisory panels and to designate
5556 respective chairs for each, contingent on the advance approval of
5657 the presiding officers for the creation and appointment of
5758 subcommittees or advisory panels containing membership external to
5859 the committee; and, be it further
5960 RESOLVED, That each joint committee, and its subcommittees
6061 and advisory panels, convene at the call of its chair or co-chairs;
6162 provided that no joint committee, nor its subcommittees or advisory
6263 panels, shall convene in a public hearing or other meeting for the
6364 transaction of business unless public notice has been posted by its
6465 chair or co-chairs at the locations specified by the Senate and
6566 House rules of procedure for posting of notice of standing
6667 committee meetings at least five calendar days in advance of the
6768 hearing or meeting; and, be it further
6869 RESOLVED, That the preceding clause be construed, for
6970 purposes of Section 551.046, Government Code, as a joint rule of the
7071 Senate and House of Representatives controlling the posting of
7172 notice for joint committees, and their subcommittees and advisory
7273 panels, in lieu of required posting with the secretary of state;
7374 and, be it further
7475 RESOLVED, That each joint committee have authority to issue
7576 process as provided in Sections 301.024-301.027, Government Code,
7677 provided that any motion for the issuance of process must receive
7778 the record vote of at least two-thirds of those present and voting,
7879 a quorum being present; and, be it further
7980 RESOLVED, That each joint committee be entitled to accept
8081 grants and donations as provided by Sections 301.032(b) and (c),
8182 Government Code, and that, on expiration of a joint committee, any
8283 unexpended funds remaining from a grant or donation be transferred
8384 in equal proportions to the accounts of the Senate and House of
8485 Representatives unless otherwise provided by the grantor or donor;
8586 and, be it further
8687 RESOLVED, That each joint committee, except as modified by or
8788 pursuant to this resolution, have all other powers and duties
8889 provided to special committees by Subchapter B, Chapter 301,
8990 Government Code, and the Senate and House rules of procedure; and,
9091 be it further
9192 RESOLVED, That the operating accounts for each joint
9293 committee created pursuant to this resolution and any grants and
9394 donations that such committee may receive be administered by the
9495 accounting and purchasing sections of the Texas Legislative
9596 Council; and, be it further
9697 RESOLVED, That the Texas Legislative Council, under the
9798 guidance of the presiding officers, be responsible for preparing
9899 and maintaining a manual of procedures for joint committees and
99100 other entities created by the legislature for which funds are to be
100101 administered by the Texas Legislative Council; the manual must
101102 establish requirements relating to printing needs, accounting
102103 procedures, ultimate disposition of records, and other
103104 administrative and financial matters; and, be it further
104105 RESOLVED, That citizen members appointed by the lieutenant
105106 governor or speaker of the House of Representatives to joint
106107 committees created pursuant to this resolution be reimbursed from
107108 funds appropriated to the Texas Legislative Council for expenses of
108109 transportation, meals, lodging, and incidentals for travel on
109110 official committee business, at rates established by the joint
110111 chairs of the Texas Legislative Council consistent with provisions
111112 of the General Appropriations Act; and, be it further
112113 RESOLVED, That citizen members appointed by the governor to
113114 joint committees created pursuant to this resolution be reimbursed
114115 from funds appropriated to the office of the governor for expenses
115116 of travel on official committee business, at rates established by
116117 the joint chairs of the Texas Legislative Council consistent with
117118 provisions of the General Appropriations Act; and, be it further
118119 RESOLVED, That citizen members appointed by the lieutenant
119120 governor to Senate select committees and citizen members appointed
120121 by the speaker of the House of Representatives to House committees
121122 expanded or created under House Rule 4, Sections 24, 57, and 58,
122123 when engaged in travel on official committee business, be
123124 reimbursed for (1) transportation expenses at the same rates as
124125 authorized for state employees by the General Appropriations Act,
125126 and (2) actual expenses for meals, lodging, and incidentals,
126127 subject to any maximum reimbursement limitations for meals and
127128 lodging set by the Senate Committee on Administration for Senate
128129 select committees and by the House Administration Committee for
129130 House select committees; and, be it further
130131 RESOLVED, That the Texas Legislative Council be authorized to
131132 reimburse the Senate and House of Representatives for expenses
132133 incurred by members of the Senate and House for transportation,
133134 meals, lodging, and incidentals for travel on official business of
134135 joint committees created pursuant to this resolution; and, be it
135136 further
136137 RESOLVED, That the final report of each joint committee be
137138 approved by a majority of the voting membership of the committee;
138139 dissenting voting members may attach statements to the final report
139140 subject to any limitations specified in the rules adopted by the
140141 committee; and, be it further
141142 RESOLVED, That each joint committee created pursuant to this
142143 resolution expire on January 14, 2025, or an earlier date specified
143144 in the proclamation creating the committee.
