4	5		SENATE CONCURRENT RESOLUTION
5	6		WHEREAS, The Texas Legislature for each of the last 20
6	7		regular sessions has adopted a concurrent resolution authorizing
7	8		the creation and appointment of joint legislative study committees
8	9		by the lieutenant governor and speaker of the House of
9	10		Representatives; and
10	11		WHEREAS, Renewal of the prior authorizations to the presiding
11	12		officers enables the legislature to address and study issues that
12	13		remain unresolved on sine die adjournment or that emerge subsequent
13	14		to that time; and
14	15		WHEREAS, It is also desirable to adopt by resolution various
15	16		rules and policies regarding the operation of joint committees to
16	17		supplement, and reconcile differences between, the Senate and House
17	18		rules of procedure; now, therefore, be it
18	19		RESOLVED, That the 88th Legislature of the State of Texas
19	20		hereby authorize the lieutenant governor and speaker of the House
20	21		of Representatives to create by mutual agreement such joint
21	22		committees as they consider necessary during the term of this
22	23		legislature; and, be it further
23	24		RESOLVED, That each joint committee created pursuant to this
24	25		resolution be composed of such combination of legislators, state
25	26		officials, or citizen members as shall be determined mutually by
26	27		the presiding officers of each house; and, be it further
27	28		RESOLVED, That on the request of the presiding officers, the
28	29		governor may appoint members to a joint committee created pursuant
29	30		to this resolution; and, be it further
30	31		RESOLVED, That the presiding officers issue for each
31	32		committee so created a joint proclamation identifying the issue or
32	33		issues to be studied and listing the committee membership or
33	34		describing the committee composition and that the proclamation be
34	35		filed with the secretary of the Senate and the chief clerk of the
35	36		House of Representatives; and, be it further
36	37		RESOLVED, That the presiding officers designate jointly a
37	38		chair, or designate alternatively two co-chairs, from among the
38	39		legislative members of the committee; and, be it further
39	40		RESOLVED, That the chair or co-chairs, acting jointly and
40	41		within four weeks of the proclamation, prepare and present to the
41	42		presiding officers a proposal for budget and staffing; and, be it
42	43		further
43	44		RESOLVED, That the chair or co-chairs be directed to use to
44	45		the greatest extent possible the existing staff and administrative
45	46		resources of committee members, standing committees, officers of
46	47		the Senate and House, and legislative service agencies; and, be it
47	48		further
48	49		RESOLVED, That the presiding officers jointly review each
49	50		budget and staffing proposal, adopt budgetary and staffing
50	51		allocations, and determine the manner in which each joint committee
51	52		is to be funded; and, be it further
52	53		RESOLVED, That the joint committee chair, or the co-chairs
53	54		acting by mutual agreement, have authority to create and appoint
54	55		subcommittees or affiliated advisory panels and to designate
55	56		respective chairs for each, contingent on the advance approval of
56	57		the presiding officers for the creation and appointment of
57	58		subcommittees or advisory panels containing membership external to
58	59		the committee; and, be it further
59	60		RESOLVED, That each joint committee, and its subcommittees
60	61		and advisory panels, convene at the call of its chair or co-chairs;
61	62		provided that no joint committee, nor its subcommittees or advisory
62	63		panels, shall convene in a public hearing or other meeting for the
63	64		transaction of business unless public notice has been posted by its
64	65		chair or co-chairs at the locations specified by the Senate and
65	66		House rules of procedure for posting of notice of standing
66	67		committee meetings at least five calendar days in advance of the
67	68		hearing or meeting; and, be it further
68	69		RESOLVED, That the preceding clause be construed, for
69	70		purposes of Section 551.046, Government Code, as a joint rule of the
70	71		Senate and House of Representatives controlling the posting of
71	72		notice for joint committees, and their subcommittees and advisory
72	73		panels, in lieu of required posting with the secretary of state;
73	74		and, be it further
74	75		RESOLVED, That each joint committee have authority to issue
75	76		process as provided in Sections 301.024-301.027, Government Code,
76	77		provided that any motion for the issuance of process must receive
77	78		the record vote of at least two-thirds of those present and voting,
78	79		a quorum being present; and, be it further
79	80		RESOLVED, That each joint committee be entitled to accept
80	81		grants and donations as provided by Sections 301.032(b) and (c),
81	82		Government Code, and that, on expiration of a joint committee, any
82	83		unexpended funds remaining from a grant or donation be transferred
83	84		in equal proportions to the accounts of the Senate and House of
84	85		Representatives unless otherwise provided by the grantor or donor;
85	86		and, be it further
86	87		RESOLVED, That each joint committee, except as modified by or
87	88		pursuant to this resolution, have all other powers and duties
88	89		provided to special committees by Subchapter B, Chapter 301,
89	90		Government Code, and the Senate and House rules of procedure; and,
90	91		be it further
91	92		RESOLVED, That the operating accounts for each joint
92	93		committee created pursuant to this resolution and any grants and
93	94		donations that such committee may receive be administered by the
94	95		accounting and purchasing sections of the Texas Legislative
95	96		Council; and, be it further
96	97		RESOLVED, That the Texas Legislative Council, under the
97	98		guidance of the presiding officers, be responsible for preparing
98	99		and maintaining a manual of procedures for joint committees and
99	100		other entities created by the legislature for which funds are to be
100	101		administered by the Texas Legislative Council; the manual must
101	102		establish requirements relating to printing needs, accounting
102	103		procedures, ultimate disposition of records, and other
103	104		administrative and financial matters; and, be it further
104	105		RESOLVED, That citizen members appointed by the lieutenant
105	106		governor or speaker of the House of Representatives to joint
106	107		committees created pursuant to this resolution be reimbursed from
107	108		funds appropriated to the Texas Legislative Council for expenses of
108	109		transportation, meals, lodging, and incidentals for travel on
109	110		official committee business, at rates established by the joint
110	111		chairs of the Texas Legislative Council consistent with provisions
111	112		of the General Appropriations Act; and, be it further
112	113		RESOLVED, That citizen members appointed by the governor to
113	114		joint committees created pursuant to this resolution be reimbursed
114	115		from funds appropriated to the office of the governor for expenses
115	116		of travel on official committee business, at rates established by
116	117		the joint chairs of the Texas Legislative Council consistent with
117	118		provisions of the General Appropriations Act; and, be it further
118	119		RESOLVED, That citizen members appointed by the lieutenant
119	120		governor to Senate select committees and citizen members appointed
120	121		by the speaker of the House of Representatives to House committees
121	122		expanded or created under House Rule 4, Sections 24, 57, and 58,
122	123		when engaged in travel on official committee business, be
123	124		reimbursed for (1) transportation expenses at the same rates as
124	125		authorized for state employees by the General Appropriations Act,
125	126		and (2) actual expenses for meals, lodging, and incidentals,
126	127		subject to any maximum reimbursement limitations for meals and
127	128		lodging set by the Senate Committee on Administration for Senate
128	129		select committees and by the House Administration Committee for
129	130		House select committees; and, be it further
130	131		RESOLVED, That the Texas Legislative Council be authorized to
131	132		reimburse the Senate and House of Representatives for expenses
132	133		incurred by members of the Senate and House for transportation,
133	134		meals, lodging, and incidentals for travel on official business of
134	135		joint committees created pursuant to this resolution; and, be it
135	136		further
136	137		RESOLVED, That the final report of each joint committee be
137	138		approved by a majority of the voting membership of the committee;
138	139		dissenting voting members may attach statements to the final report
139	140		subject to any limitations specified in the rules adopted by the
140	141		committee; and, be it further
141	142		RESOLVED, That each joint committee created pursuant to this
142	143		resolution expire on January 14, 2025, or an earlier date specified
143	144		in the proclamation creating the committee.
