| 5 | 5 | | WHEREAS, The Windfall Elimination Provision was enacted in |
|---|
| 6 | 6 | | 1983 to equalize the earned Social Security benefits of workers who |
|---|
| 7 | 7 | | spend part of their careers in exempt public service and workers who |
|---|
| 8 | 8 | | spend their entire careers participating in social security; and |
|---|
| 9 | 9 | | WHEREAS, The Windfall Elimination Provision reduces the |
|---|
| 10 | 10 | | Social Security benefits of public servants who have received a |
|---|
| 11 | 11 | | pension that is not subject to Social Security taxes, including |
|---|
| 12 | 12 | | thousands of teachers in Texas as well as the spouses and children |
|---|
| 13 | 13 | | of these public servants; and |
|---|
| 14 | 14 | | WHEREAS, The flawed application of the Windfall Elimination |
|---|
| 15 | 15 | | Provision diminishes Texans' retirement security and fails to |
|---|
| 16 | 16 | | recognize their rightfully earned Social Security and public |
|---|
| 17 | 17 | | pension benefits; and |
|---|
| 18 | 18 | | WHEREAS, For years, the United States Congress has failed to |
|---|
| 19 | 19 | | act to remove this detriment to many citizens of Texas, including |
|---|
| 20 | 20 | | teachers; now, therefore, be it |
|---|
| 21 | 21 | | RESOLVED, That the Senate of the 88th Texas Legislature |
|---|
| 22 | 22 | | hereby respectfully urge the United States Congress to take swift |
|---|
| 23 | 23 | | action to replace the Windfall Elimination Provision with a more |
|---|
| 24 | 24 | | fair and just formula that accurately reflects the contributions of |
|---|
| 25 | 25 | | all American workers to the Social Security system; and, be it |
|---|
| 26 | 26 | | further |
|---|
| 27 | 27 | | RESOLVED, That the secretary of the Senate forward official |
|---|
| 28 | 28 | | copies of this resolution to the president of the United States, to |
|---|
| 29 | 29 | | the president of the Senate and the speaker of the House of |
|---|
| 30 | 30 | | Representatives of the United States Congress, and to all the |
|---|
| 31 | 31 | | remembers of the Texas delegation to Congress with the request that |
|---|
| 32 | 32 | | this resolution be entered in the Congressional Record as a |
|---|
| 33 | 33 | | memorial to the Congress of the United States of America. |
