104 SENATE CONCURRENT RESOLUTION
115 WHEREAS, Transnational cartels are exploiting weak and
126 unsecure points along the United States Southern Border to expand
137 their criminal enterprises and terrorize Americans; and
148 WHEREAS, 379 million deadly doses of fentanyl were seized by
159 U.S. authorities in 2022, enough to kill every American man, woman,
1610 and child; and
1711 WHEREAS, The State of Texas is charged with protecting its
1812 citizens and is empowered to defend itself against invasion under
19- Article 1, Section 10 of the United States Constitution; and
13+ Article 1, Section 10 of the United States Constitution;
2014 WHEREAS, Article IV, Section 7 of the Texas Constitution
2115 states that the Governor of Texas "shall be Commander-in-Chief of
2216 the military forces of the State" and has the power to organize
2317 armed forces to "repel invasions"; and
2418 WHEREAS, The United States Federal Government is charged, in
2519 the United States Constitution, to "provide for the common defense"
2620 and protect its States "against invasion" under the Preamble and
2721 Article IV, Section 4, respectively; and
2822 WHEREAS, The State of Texas has spent $4 billion on border
2923 initiatives in the 2021-2022 biennium, investing in
3024 state-of-the-art detection equipment, a border wall, and calling up
31- tens of thousands of members of National and State Guard units; and
25+ tens of thousands of members of National and State Guard units;
3226 WHEREAS, Operation Lone Star's multi-agency effort has led to
3327 over 352,000 illegal immigrant apprehensions and more than 23,000
3428 criminal arrests; and
3529 WHEREAS, Both human and drug trafficking by transnational
3630 cartels have created a security threat and humanitarian disaster by
3731 terrorizing residents of the United States and the State of Texas;
3832 and
3933 WHEREAS, Four United States citizens were kidnapped by a
4034 cartel abroad in early March, two of them brutally murdered.
4135 Unfortunately, the tragic incident was not isolated, and violence
4236 permeates any area these transnational cartels inhabit; and
43- WHEREAS, The continual violation of Texas' sovereignty and
37+ WHEREAS, The continual violation of Texas's sovereignty and
4438 territorial integrity has resulted in reports of residents of Texas
4539 being assaulted, threatened with violence, and robbed; now,
4640 therefore, be it
4741 RESOLVED, That the 88th Legislature of the State of Texas
4842 hereby declare an invasion by transnational cartel terrorists under
4943 Article 1, Section 10 of the United States Constitution and Article
5044 IV, Section 7 of the Texas Constitution; and, be it further
5145 RESOLVED, That the Legislature ask Governor Abbott to
5246 accelerate the construction of a wall along the Southern Border,
5347 utilizing Eminent Domain where necessary, to prevent the entrance
5448 of transnational cartels into the state; and, be it further
5549 RESOLVED, That the Legislature demand that the U.S. Congress
5650 recognize its obligation under the U.S. Constitution to "provide
5751 for the common defense" by voting to deploy U.S. military forces to
5852 combat transnational cartels; and, be it further
5953 RESOLVED, That the Legislature demand that the federal
6054 government allocate more financial support to Texas' border
6155 security wall and reimburse Texas for past expenditures on security
6256 efforts to repel invaders at its Southern Border; and, be it further
6357 RESOLVED, That the Texas Secretary of State forward official
6458 copies of this resolution to the President of the United States, to
6559 the President of the Senate and the Speaker of the House of
6660 Representatives of the United States Congress, and to all members
6761 of the Texas delegation to Congress with the request that this
6862 resolution be officially entered in the Congressional Record as a
6963 memorial to the Congress of the United States of America.
