55 A JOINT RESOLUTION
66 proposing a constitutional amendment to entitle all component
77 institutions of The Texas A&M University System and The University
88 of Texas System to participate in the income and other benefits of
99 the permanent university fund.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 18, Article VII, Texas Constitution, is
1212 amended by amending Subsections (a) and (b) and adding Subsection
1313 (a-1) to read as follows:
1414 (a) The Board of Regents of The Texas A&M University System
1515 may issue bonds and notes not to exceed a total amount of 10 percent
1616 of the cost value of the investments and other assets of the
1717 permanent university fund (exclusive of real estate) at the time of
1818 the issuance thereof, and may pledge all or any part of its
1919 one-third interest in the available university fund to secure the
2020 payment of the principal and interest of those bonds and notes, for
2121 the purpose of acquiring land either with or without permanent
2222 improvements, constructing and equipping buildings or other
2323 permanent improvements, major repair and rehabilitation of
2424 buildings and other permanent improvements, acquiring capital
2525 equipment and library books and library materials, and refunding
2626 bonds or notes issued under this Section or prior law, at or for The
2727 Texas A&M University System administration and all [the following]
2828 component institutions of the system[:
2929 [(1) Texas A&M University, including its medical
3030 college which the legislature may authorize as a separate medical
3131 institution;
3232 [(2) Prairie View A&M University, including its
3333 nursing school in Houston;
3434 [(3) Tarleton State University;
3535 [(4) Texas A&M University at Galveston;
3636 [(5) Texas Forest Service;
3737 [(6) Texas Agricultural Experiment Stations;
3838 [(7) Texas Agricultural Extension Service;
3939 [(8) Texas Engineering Experiment Stations;
4040 [(9) Texas Transportation Institute; and
4141 [(10) Texas Engineering Extension Service].
4242 (a-1) In applying a portion of its one-third interest in the
4343 available university fund to the payment of the principal of and
4444 interest on bonds and notes issued under Subsection (a) of this
4545 section, the Board of Regents of The Texas A&M University System
4646 shall include sufficient funds to pay the principal of and interest
4747 on all bonds and notes, including refunding bonds and notes,
4848 previously issued for the benefit of component institutions of the
4949 system under Section 17(b) of this article.
5050 (b) The Board of Regents of The University of Texas System
5151 may issue bonds and notes not to exceed a total amount of 20 percent
5252 of the cost value of investments and other assets of the permanent
5353 university fund (exclusive of real estate) at the time of issuance
5454 thereof, and may pledge all or any part of its two-thirds interest
5555 in the available university fund to secure the payment of the
5656 principal and interest of those bonds and notes, for the purpose of
5757 acquiring land either with or without permanent improvements,
5858 constructing and equipping buildings or other permanent
5959 improvements, major repair and rehabilitation of buildings and
6060 other permanent improvements, acquiring capital equipment and
6161 library books and library materials, and refunding bonds or notes
6262 issued under this section or prior law, at or for The University of
6363 Texas System administration and all [the following] component
6464 institutions of the system[:
6565 [(1) The University of Texas at Arlington;
6666 [(2) The University of Texas at Austin;
6767 [(3) The University of Texas at Dallas;
6868 [(4) The University of Texas at El Paso;
6969 [(5) The University of Texas of the Permian Basin;
7070 [(6) The University of Texas at San Antonio;
7171 [(7) The University of Texas at Tyler;
7272 [(8) The University of Texas Health Science Center at
7373 Dallas;
7474 [(9) The University of Texas Medical Branch at
7575 Galveston;
7676 [(10) The University of Texas Health Science Center at
7777 Houston;
7878 [(11) The University of Texas Health Science Center at
7979 San Antonio;
8080 [(12) The University of Texas System Cancer Center;
8181 [(13) The University of Texas Health Center at Tyler;
8282 and
8383 [(14) The University of Texas Institute of Texan
8484 Cultures at San Antonio].
8585 SECTION 2. Section 17(b), Article VII, Texas Constitution,
8686 is amended to read as follows:
8787 (b) The funds appropriated under Subsection (a) of this
8888 section shall be for the use of the following eligible agencies and
8989 institutions of higher education (even though their names may be
9090 changed):
9191 (1) [East Texas State University including East Texas
9292 State University at Texarkana;
9393 [(2)] Lamar University including Lamar State
9494 College—Orange [University at Orange] and Lamar State College—Port
9595 Arthur [University at Port Arthur];
9696 (2) [(3)] Midwestern State University;
9797 (3) [(4)] University of North Texas;
9898 (4) [(5) The University of Texas--Pan American
9999 including The University of Texas at Brownsville;
100100 [(6)] Stephen F. Austin State University;
101101 (5) [(7)] Texas College of Osteopathic Medicine;
102102 (6) [(8)] Texas State University System
103103 Administration and the following component institutions:
104104 (7) [(9)] Sam Houston State University;
105105 (8) [(10) Southwest] Texas State University;
106106 (9) [(11)] Sul Ross State University including Rio
107107 Grande College [Uvalde Study Center];
108108 (10) [(12)] Texas Southern University;
109109 (11) [(13)] Texas Tech University;

124124 [(26)] Texas State Technical College System and its
125125 campuses, but not its extension centers or programs.
126126 SECTION 3. Article VII, Texas Constitution, is amended by
127127 adding Section 17A to read as follows:
128128 Sec. 17A. TEMPORARY PROVISION. (a) The transfer of
129129 component institutions of The Texas A&M University System from
130130 Section 17 of this article to Section 18 of this article by the
131131 constitutional amendment proposed by the 88th Legislature, Regular
132132 Session, 2023, applies beginning with the state fiscal year that
133133 begins September 1, 2024.
134134 (b) Beginning with the state fiscal year that begins
135135 September 1, 2024, the funds allocated as provided by Section 17(d)
136136 of this article to the component institutions of The Texas A&M
137137 University System shall be allocated to the other agencies and
138138 institutions eligible to receive funds under Section 17 of this
139139 article in proportion to the other funds allocated to those
140140 agencies and institutions as provided by Section 17(d) of this
141141 article, until the legislature or designated agency eliminates the
142142 component institutions of The Texas A&M University System from the
143143 formula and allocations made under Section 17(d) of this article.
144144 (c) This section expires September 1, 2031.
145145 SECTION 4. This proposed constitutional amendment shall be
146146 submitted to the voters at an election to be held November 7, 2023.
147147 The ballot shall be printed to permit voting for or against the
148148 following proposition: "The constitutional amendment to entitle
149149 all component institutions of The Texas A&M University System and
150150 The University of Texas System to participate in the income and
151151 other benefits of the permanent university fund."
