6	6	proposing a constitutional amendment to entitle all component
7	7	institutions of The Texas A&M University System and The University
8	8	of Texas System to participate in the income and other benefits of
9	9	the permanent university fund.
10	10	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 18, Article VII, Texas Constitution, is
12	12	amended by amending Subsections (a) and (b) and adding Subsection
13	13	(a-1) to read as follows:
14	14	(a) The Board of Regents of The Texas A&M University System
15	15	may issue bonds and notes not to exceed a total amount of 10 percent
16	16	of the cost value of the investments and other assets of the
17	17	permanent university fund (exclusive of real estate) at the time of
18	18	the issuance thereof, and may pledge all or any part of its
19	19	one-third interest in the available university fund to secure the
20	20	payment of the principal and interest of those bonds and notes, for
21	21	the purpose of acquiring land either with or without permanent
22	22	improvements, constructing and equipping buildings or other
23	23	permanent improvements, major repair and rehabilitation of
24	24	buildings and other permanent improvements, acquiring capital
25	25	equipment and library books and library materials, and refunding
26	26	bonds or notes issued under this Section or prior law, at or for The
27	27	Texas A&M University System administration and all [the following]
28	28	component institutions of the system[:
29	29	[(1) Texas A&M University, including its medical
30	30	college which the legislature may authorize as a separate medical
31	31	institution;
32	32	[(2) Prairie View A&M University, including its
33	33	nursing school in Houston;
34	34	[(3) Tarleton State University;
35	35	[(4) Texas A&M University at Galveston;
36	36	[(5) Texas Forest Service;
37	37	[(6) Texas Agricultural Experiment Stations;
38	38	[(7) Texas Agricultural Extension Service;
39	39	[(8) Texas Engineering Experiment Stations;
40	40	[(9) Texas Transportation Institute; and
41	41	[(10) Texas Engineering Extension Service].
42	42	(a-1) In applying a portion of its one-third interest in the
43	43	available university fund to the payment of the principal of and
44	44	interest on bonds and notes issued under Subsection (a) of this
45	45	section, the Board of Regents of The Texas A&M University System
46	46	shall include sufficient funds to pay the principal of and interest
47	47	on all bonds and notes, including refunding bonds and notes,
48	48	previously issued for the benefit of component institutions of the
49	49	system under Section 17(b) of this article.
50	50	(b) The Board of Regents of The University of Texas System
51	51	may issue bonds and notes not to exceed a total amount of 20 percent
52	52	of the cost value of investments and other assets of the permanent
53	53	university fund (exclusive of real estate) at the time of issuance
54	54	thereof, and may pledge all or any part of its two-thirds interest
55	55	in the available university fund to secure the payment of the
56	56	principal and interest of those bonds and notes, for the purpose of
57	57	acquiring land either with or without permanent improvements,
58	58	constructing and equipping buildings or other permanent
59	59	improvements, major repair and rehabilitation of buildings and
60	60	other permanent improvements, acquiring capital equipment and
61	61	library books and library materials, and refunding bonds or notes
62	62	issued under this section or prior law, at or for The University of
63	63	Texas System administration and all [the following] component
64	64	institutions of the system[:
65	65	[(1) The University of Texas at Arlington;
66	66	[(2) The University of Texas at Austin;
67	67	[(3) The University of Texas at Dallas;
68	68	[(4) The University of Texas at El Paso;
69	69	[(5) The University of Texas of the Permian Basin;
70	70	[(6) The University of Texas at San Antonio;
71	71	[(7) The University of Texas at Tyler;
72	72	[(8) The University of Texas Health Science Center at
73	73	Dallas;
74	74	[(9) The University of Texas Medical Branch at
75	75	Galveston;
76	76	[(10) The University of Texas Health Science Center at
77	77	Houston;
78	78	[(11) The University of Texas Health Science Center at
79	79	San Antonio;
80	80	[(12) The University of Texas System Cancer Center;
81	81	[(13) The University of Texas Health Center at Tyler;
82	82	and
83	83	[(14) The University of Texas Institute of Texan
84	84	Cultures at San Antonio].
85	85	SECTION 2. Section 17(b), Article VII, Texas Constitution,
86	86	is amended to read as follows:
87	87	(b) The funds appropriated under Subsection (a) of this
88	88	section shall be for the use of the following eligible agencies and
89	89	institutions of higher education (even though their names may be
90	90	changed):
91	91	(1) [East Texas State University including East Texas
92	92	State University at Texarkana;
93	93	[(2)] Lamar University including Lamar State
94	94	College—Orange [University at Orange] and Lamar State College—Port
95	95	Arthur [University at Port Arthur];
96	96	(2) [(3)] Midwestern State University;
97	97	(3) [(4)] University of North Texas;
98	98	(4) [(5) The University of Texas--Pan American
99	99	including The University of Texas at Brownsville;
100	100	[(6)] Stephen F. Austin State University;
101	101	(5) [(7)] Texas College of Osteopathic Medicine;
102	102	(6) [(8)] Texas State University System
103	103	Administration and the following component institutions:
104	104	(7) [(9)] Sam Houston State University;
105	105	(8) [(10) Southwest] Texas State University;
106	106	(9) [(11)] Sul Ross State University including Rio
107	107	Grande College [Uvalde Study Center];

125	125	campuses, but not its extension centers or programs.
126	126	SECTION 3. Article VII, Texas Constitution, is amended by
127	127	adding Section 17A to read as follows:
128	128	Sec. 17A. TEMPORARY PROVISION. (a) The transfer of
129	129	component institutions of The Texas A&M University System from
130	130	Section 17 of this article to Section 18 of this article by the
131	131	constitutional amendment proposed by the 88th Legislature, Regular
132	132	Session, 2023, applies beginning with the state fiscal year that
133	133	begins September 1, 2024.
134	134	(b) Beginning with the state fiscal year that begins
135	135	September 1, 2024, the funds allocated as provided by Section 17(d)
136	136	of this article to the component institutions of The Texas A&M
137	137	University System shall be allocated to the other agencies and
138	138	institutions eligible to receive funds under Section 17 of this
139	139	article in proportion to the other funds allocated to those
140	140	agencies and institutions as provided by Section 17(d) of this
141	141	article, until the legislature or designated agency eliminates the
142	142	component institutions of The Texas A&M University System from the
143	143	formula and allocations made under Section 17(d) of this article.
144	144	(c) This section expires September 1, 2031.
145	145	SECTION 4. This proposed constitutional amendment shall be
146	146	submitted to the voters at an election to be held November 7, 2023.
147	147	The ballot shall be printed to permit voting for or against the
148	148	following proposition: "The constitutional amendment to entitle
149	149	all component institutions of The Texas A&M University System and
150	150	The University of Texas System to participate in the income and
151	151	other benefits of the permanent university fund."
