55 A JOINT RESOLUTION
66 rescinding the automatic rescission of certain applications made by
77 the Texas Legislature to the United States Congress to call a
88 national convention under Article V of the United States
99 Constitution for proposing any amendment to that constitution.
1010 WHEREAS, The 85th Legislature of the State of Texas, Regular
1111 Session, 2017, enacted S.J.R. No. 38 to officially rescind, repeal,
1212 revoke, cancel, void, and nullify certain applications from Texas
1313 legislatures prior to the 85th Legislature, Regular Session, 2017,
1414 that apply to the United States Congress for the calling of a
1515 convention under Article V of the United States Constitution; and
1616 WHEREAS, S.J.R. No. 38 additionally provided that any
1717 application to the United States Congress for the calling of a
1818 convention under Article V of the United States Constitution that
1919 is submitted by the Texas Legislature during or after the Regular
2020 Session of the 85th Legislature will be automatically rescinded,
2121 repealed, revoked, canceled, voided, and nullified if the
2222 applicable convention is not called on or before the eighth
2323 anniversary of the date the last legislative vote is taken on the
2424 application; now, therefore, be it
2525 RESOLVED, That the 88th Legislature of the State of Texas,
2626 Regular Session, 2023, hereby officially rescinds, repeals,
2727 revokes, cancels, voids, and nullifies the provision of S.J.R.
2828 No. 38 that provided for the automatic rescission, repeal,
2929 revocation, cancellation, voiding, and nullification of any
3030 application from the Texas Legislature after the eighth anniversary
3131 of the date the last legislative vote was taken on the application;
3232 and, be it further
3333 RESOLVED, That the Texas secretary of state forward official
3434 copies of this resolution to the president of the United States, to
3535 the speaker of the House of Representatives of the United States, to
3636 the vice president of the United States in the vice president's
3737 capacity as the presiding officer of the Senate of the United States
3838 at the office located in the United States Capitol Building, and to
3939 all members of the Texas delegation to Congress with the request
4040 that this resolution be officially entered in the Congressional
4141 Record.
