6 | 6 | | proposing a constitutional amendment creating the water for Texas |

7 | 7 | | fund to assist in financing water projects in this state. |

8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Article III, Texas Constitution, is amended by |
---|
10 | 10 | | adding Section 49-d-16 to read as follows: |
---|
11 | 11 | | Sec. 49-d-16. (a) The water for Texas fund is created as a |
---|
12 | 12 | | special fund in the state treasury outside the general revenue |
---|
13 | 13 | | fund. The fund is administered by the Texas Water Development Board |
---|
14 | 14 | | or by that board's successor in function as provided by general law. |
---|
15 | 15 | | The fund is not subject to legislative appropriation. |
---|
16 | 16 | | (b) The administrator of the water for Texas fund may use |
---|
17 | 17 | | the fund only to disburse money to other funds administered by the |
---|
18 | 18 | | Texas Water Development Board or that board's successor in |
---|
19 | 19 | | function. The administrator may restore to the fund money |
---|
20 | 20 | | disbursed from the fund and deposited to the credit of another fund. |
---|
21 | 21 | | Legislative appropriation is not required for the administrator to |
---|
22 | 22 | | disburse money from, or restore money to, the fund. |
---|
23 | 23 | | (c) The administrator of the water for Texas fund may |
---|
24 | 24 | | establish separate accounts in the fund as necessary or convenient |
---|
25 | 25 | | to administer the fund. |
---|
26 | 26 | | (d) The water for Texas fund consists of: |
---|
27 | 27 | | (1) money transferred or deposited to the credit of |
---|
28 | 28 | | the fund by general law, including money from any source |
---|
29 | 29 | | transferred or deposited to the credit of the fund at the discretion |
---|
30 | 30 | | of the administrator of the water for Texas fund as authorized by |
---|
31 | 31 | | general law; |
---|
32 | 32 | | (2) any other revenue that the legislature by statute |
---|
33 | 33 | | dedicates for deposit to the credit of the fund; |
---|
34 | 34 | | (3) investment earnings and interest earned on amounts |
---|
35 | 35 | | credited to the fund; |
---|
36 | 36 | | (4) money from gifts, grants, or donations to the |
---|
37 | 37 | | fund; and |
---|
38 | 38 | | (5) the redeposit of money disbursed from the fund. |
---|
39 | 39 | | (e) The legislature by general law shall provide for the |
---|
40 | 40 | | manner in which money from the water for Texas fund may be used, |
---|
41 | 41 | | subject to the limitations provided by this section. |
---|
42 | 42 | | (f) The legislature by general law may provide for costs of |
---|
43 | 43 | | investment of the water for Texas fund to be paid from that fund. |
---|
44 | 44 | | SECTION 2. This proposed constitutional amendment shall be |
---|
45 | 45 | | submitted to the voters at an election to be held November 7, 2023. |
---|
46 | 46 | | The ballot shall be printed to permit voting for or against the |
---|
47 | 47 | | proposition: "The constitutional amendment creating the water for |
---|
48 | 48 | | Texas fund to assist in financing water projects in this state." |
