55 A JOINT RESOLUTION
66 proposing a constitutional amendment creating the water for Texas
77 fund to assist in financing water projects in this state.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article III, Texas Constitution, is amended by
1010 adding Section 49-d-16 to read as follows:
1111 Sec. 49-d-16. (a) The water for Texas fund is created as a
1212 special fund in the state treasury outside the general revenue
1313 fund. The fund is administered by the Texas Water Development Board
1414 or by that board's successor in function as provided by general law.
1515 The fund is not subject to legislative appropriation.
1616 (b) The administrator of the water for Texas fund may use
1717 the fund only to disburse money to other funds administered by the
1818 Texas Water Development Board or that board's successor in
1919 function. The administrator may restore to the fund money
2020 disbursed from the fund and deposited to the credit of another fund.
2121 Legislative appropriation is not required for the administrator to
2222 disburse money from, or restore money to, the fund.
2323 (c) The administrator of the water for Texas fund may
2424 establish separate accounts in the fund as necessary or convenient
2525 to administer the fund.
2626 (d) The water for Texas fund consists of:
2727 (1) money transferred or deposited to the credit of
2828 the fund by general law, including money from any source
2929 transferred or deposited to the credit of the fund at the discretion
3030 of the administrator of the water for Texas fund as authorized by
3131 general law;
3232 (2) any other revenue that the legislature by statute
3333 dedicates for deposit to the credit of the fund;
3434 (3) investment earnings and interest earned on amounts
3535 credited to the fund;
3636 (4) money from gifts, grants, or donations to the
3737 fund; and
3838 (5) the redeposit of money disbursed from the fund.
3939 (e) The legislature by general law shall provide for the
4040 manner in which money from the water for Texas fund may be used,
4141 subject to the limitations provided by this section.
4242 (f) The legislature by general law may provide for costs of
4343 investment of the water for Texas fund to be paid from that fund.
4444 SECTION 2. This proposed constitutional amendment shall be
4545 submitted to the voters at an election to be held November 7, 2023.
4646 The ballot shall be printed to permit voting for or against the
4747 proposition: "The constitutional amendment creating the water for
4848 Texas fund to assist in financing water projects in this state."
