                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION             April 3, 2023       TO: Honorable Charles Schwertner, Chair, Senate Committee on Business & Commerce     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: SJR57 by Parker (Proposing a constitutional amendment authorizing the legislature to provide for legislative review and approval of state agency rules.), As Introduced     No significant fiscal implication to the State is anticipated, other than the cost of publication.  The cost to the state for publication of the resolution is $204,406. The joint resolution would amend Article II of the Constitution by adding Section 2 which would authorize the Legislature to prescribe a process to review rules adopted by agencies in the executive department to ensure that agency rules are consistent with legislative intent. It would also allow the Legislature to approve or reject all or any part of an adopted rule. Their determination would not be subject to disapproval by the governor.The Comptroller of Public Accounts indicates that the agency would need to hire one Attorney V to manage the additional rulemaking projects that would be anticipated after implementation. This analysis assumes that the costs associated with the bill could be absorbed using existing resources.  Local Government ImpactNo fiscal implication to units of local government is anticipated.
