9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Article II, Texas Constitution, is amended by |
---|
11 | 11 | | adding Section 2 to read as follows: |
---|
12 | 12 | | Sec. 2. The legislature may prescribe a process for the |
---|
13 | 13 | | legislative review of rules adopted by agencies in the executive |
---|
14 | 14 | | department for the purpose of ensuring that each agency rule is |
---|
15 | 15 | | consistent with the intent of the legislature in enacting the |
---|
16 | 16 | | statute the rule is adopted to implement, interpret, or prescribe. |
---|
17 | 17 | | The process prescribed by the legislature may provide the manner by |
---|
18 | 18 | | which the legislative review is conducted, and may allow for the |
---|
19 | 19 | | approval or rejection by the legislature of all or any part of an |
---|
20 | 20 | | adopted rule. Notwithstanding Sections 14 and 15, Article IV, of |
---|
21 | 21 | | this constitution, or any other law, the approval or rejection of |
---|
22 | 22 | | all or any part of an adopted rule by the legislature is not subject |
---|
23 | 23 | | to disapproval by the governor. |
---|
24 | 24 | | SECTION 2. This proposed constitutional amendment shall be |
---|
25 | 25 | | submitted to the voters at an election to be held November 7, 2023. |
---|
26 | 26 | | The ballot shall be printed to permit voting for or against the |
---|
27 | 27 | | proposition: "The constitutional amendment authorizing the |
---|
28 | 28 | | legislature to provide for legislative review and approval of state |
---|
29 | 29 | | agency rules." |
