99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article II, Texas Constitution, is amended by
1111 adding Section 2 to read as follows:
1212 Sec. 2. The legislature may prescribe a process for the
1313 legislative review of rules adopted by agencies in the executive
1414 department for the purpose of ensuring that each agency rule is
1515 consistent with the intent of the legislature in enacting the
1616 statute the rule is adopted to implement, interpret, or prescribe.
1717 The process prescribed by the legislature may provide the manner by
1818 which the legislative review is conducted, and may allow for the
1919 approval or rejection by the legislature of all or any part of an
2020 adopted rule. Notwithstanding Sections 14 and 15, Article IV, of
2121 this constitution, or any other law, the approval or rejection of
2222 all or any part of an adopted rule by the legislature is not subject
2323 to disapproval by the governor.
2424 SECTION 2. This proposed constitutional amendment shall be
2525 submitted to the voters at an election to be held November 7, 2023.
2626 The ballot shall be printed to permit voting for or against the
2727 proposition: "The constitutional amendment authorizing the
2828 legislature to provide for legislative review and approval of state
2929 agency rules."
