9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article I, Texas Constitution, is amended by | |
11 | 11 | adding Section 36 to read as follows: | |
12 | 12 | Sec. 36. RIGHT TO REFUSE MEDICAL TREATMENT; ACCESS TO | |
13 | 13 | PUBLIC ACCOMMODATIONS. (a) Each individual residing in this state | |
14 | 14 | has the right to refuse any medical treatment, including a | |
15 | 15 | procedure, vaccine, medical device, or prophylactic, and a person | |
16 | 16 | may not interfere with or impede that right in any manner. | |
17 | 17 | (b) A person may not restrict or deny an individual's access | |
18 | 18 | to public accommodations based on the individual's exercise of the | |
19 | 19 | right guaranteed under Subsection (a) of this section to refuse a | |
20 | 20 | medical treatment. | |
21 | 21 | SECTION 2. This proposed constitutional amendment shall be | |
22 | 22 | submitted to the voters at an election to be held November 7, 2023. | |
23 | 23 | The ballot shall be printed to permit voting for or against the | |
24 | 24 | proposition: "The constitutional amendment guaranteeing the right | |
25 | 25 | of individuals to refuse medical treatments and to access public | |
26 | 26 | accommodations." |
