	7	+	A JOINT RESOLUTION
4	8		proposing a constitutional amendment providing for the creation of
5	9		the centennial parks conservation fund.
6	10		BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	11		SECTION 1. Article III, Texas Constitution, is amended by
8	12		adding Section 49-e-1 to read as follows:
9	13		Sec. 49-e-1. (a) The centennial parks conservation fund is
10	14		established as a trust fund outside the treasury. In accordance
11	15		with general law, the fund may be used only for the creation and
12	16		improvement of state parks.
13	17		(b) The centennial parks conservation fund consists of:
14		-	(1) money appropriated, credited, or transferred to
15		-	the fund by the legislature;
16		-	(2) gifts, grants, and donations received by the Parks
17		-	and Wildlife Department or the department's successor in function
18		-	for a purpose for which money in the fund may be used under this
19		-	section; and
	18	+	(1) money appropriated to the fund;
	19	+	(2) money transferred or deposited to the credit of
	20	+	the fund by general law;
20	21		(3) investment earnings and interest earned on amounts
21		-	credited to the fund.

22	25		(c) The legislature may appropriate money from the
23	26		centennial parks conservation fund to the Parks and Wildlife
24	27		Department or the department's successor in function for the
25	28		purposes prescribed for the fund by this section and general law.
26	29		(d) For purposes of Section 22, Article VIII, of this
27	30		constitution:
28	31		(1) money in the centennial parks conservation fund is
29	32		dedicated by this constitution; and
30	33		(2) an appropriation of state tax revenues for the
31	34		purpose of depositing money to the credit of the fund is treated as
32	35		if it were an appropriation of revenues dedicated by this
33	36		constitution.
34		-	(e) The reasonable expenses of managing the fund and its
35		-	assets shall be paid from the fund.
	37	+	(d-1) On January 1, 2024, the comptroller of public accounts
	38	+	shall transfer $1 billion of the unencumbered balance of the
	39	+	general revenue fund that exists on that date to the centennial
	40	+	parks conservation fund. This subsection expires December 31,
	41	+	2024.
36	42		SECTION 2. This proposed constitutional amendment shall be
37	43		submitted to the voters at an election to be held November 7, 2023.
38	44		The ballot shall be printed to permit voting for or against the
39	45		proposition: "The constitutional amendment providing for the
40	46		creation of the centennial parks conservation fund to be used for
41	47		the creation and improvement of state parks."
