7+ A JOINT RESOLUTION
48 proposing a constitutional amendment providing for the creation of
59 the centennial parks conservation fund.
610 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
711 SECTION 1. Article III, Texas Constitution, is amended by
812 adding Section 49-e-1 to read as follows:
913 Sec. 49-e-1. (a) The centennial parks conservation fund is
1014 established as a trust fund outside the treasury. In accordance
1115 with general law, the fund may be used only for the creation and
1216 improvement of state parks.
1317 (b) The centennial parks conservation fund consists of:
14- (1) money appropriated, credited, or transferred to
15- the fund by the legislature;
16- (2) gifts, grants, and donations received by the Parks
17- and Wildlife Department or the department's successor in function
18- for a purpose for which money in the fund may be used under this
19- section; and
18+ (1) money appropriated to the fund;
19+ (2) money transferred or deposited to the credit of
20+ the fund by general law;
2021 (3) investment earnings and interest earned on amounts
21- credited to the fund.

2225 (c) The legislature may appropriate money from the
2326 centennial parks conservation fund to the Parks and Wildlife
2427 Department or the department's successor in function for the
2528 purposes prescribed for the fund by this section and general law.
2629 (d) For purposes of Section 22, Article VIII, of this
2730 constitution:
2831 (1) money in the centennial parks conservation fund is
2932 dedicated by this constitution; and
3033 (2) an appropriation of state tax revenues for the
3134 purpose of depositing money to the credit of the fund is treated as
3235 if it were an appropriation of revenues dedicated by this
3336 constitution.
34- (e) The reasonable expenses of managing the fund and its
35- assets shall be paid from the fund.
37+ (d-1) On January 1, 2024, the comptroller of public accounts
38+ shall transfer $1 billion of the unencumbered balance of the
39+ general revenue fund that exists on that date to the centennial
40+ parks conservation fund. This subsection expires December 31,
41+ 2024.
3642 SECTION 2. This proposed constitutional amendment shall be
3743 submitted to the voters at an election to be held November 7, 2023.
3844 The ballot shall be printed to permit voting for or against the
3945 proposition: "The constitutional amendment providing for the
4046 creation of the centennial parks conservation fund to be used for
4147 the creation and improvement of state parks."
