55 WHEREAS, The passing of Judge Carl E. F. Dally on October
66 19, 2022, at the age of 98, brought a profound loss to his family,
77 friends, and colleagues; and
88 WHEREAS, Born to Emsley and Ethel Dally on January 22,
99 1924, Carl Dally grew up in rural Merino, Colorado, with three
1010 younger siblings, Robert, Louise, and Bernice; he attended
1111 Colorado A&M, Michigan State University, and the University of
1212 Denver, where he earned his bachelor's degree in economics and a
1313 law degree; coming of age during World War II, he served in the
1414 European Theater from 1942 to 1945 as a sergeant in the U.S. Army
1515 Air Corps 57th Bomb Wing; he returned to military service as a
1616 captain in the U.S. Air Force during the Korean War; and
1717 WHEREAS, While stationed at Bryan Air Force Base, Judge
1818 Dally met a native Texan, the former Edith Carr, and fell in love;
1919 they married in 1952, and the following year they were blessed
2020 with a son, William "Bill" Carl Dally, born on his mother's
2121 birthday, February 9; guided by the motto "happy wife, happy
2222 life," Judge Dally settled permanently in Texas, yet he made it a
2323 point to visit his family in Colorado every year; and
2424 WHEREAS, Judge Dally began his career in Houston as an
2525 assistant district attorney for Harris County; later, he became a
2626 partner at Briscoe, Dally, & Shaffer, and he also lectured in
2727 criminal law at South Texas College of Law; in 1971, he was
2828 appointed a commissioner of the Texas Court of Criminal Appeals;
2929 when Texas voters approved a constitutional amendment in 1977 to
3030 increase the Texas Court of Criminal Appeals from five to nine
3131 judges, he was one of two commissioners who automatically became
3232 a judge, and he served from 1978 to 1983; he took pride in his
3333 service to the public, and his colleagues knew him for his
3434 integrity, work ethic, and dedication to the rule of law; and
3535 WHEREAS, From 1983 to 1993, Judge Dally served his fellow
3636 Texans as the assistant state prosecuting attorney in the Office
3737 of the State Prosecuting Attorney; he was also a visiting judge
3838 on the Third Court of Appeals and wrote opinions and served as a
3939 mentor until well into his 80s; and
4040 WHEREAS, Christ was always at the center of his heart, and
4141 Judge Dally enjoyed being a Sunday school teacher at Second
4242 Baptist Church of Houston, a deacon at Hyde Park Baptist Church,
4343 and a member of Austin Baptist Church; and
4444 WHEREAS, Judge Dally's last and favorite job was being a
4545 devoted and doting grandpa to his granddaughter, Laura, who had
4646 hoped to introduce him to his great-granddaughter, Ella, who was
4747 born less than a month after his passing; and
4848 WHEREAS, Carl Dally made a lasting, positive difference
4949 through his professional and civic contributions and devotion to
5050 his family, and although he is deeply missed by those he left
5151 behind, he will forever hold a special place in their hearts;
5252 now, therefore, be it
5353 RESOLVED, That the Senate of the State of Texas, 88th
5454 Legislature, hereby pay tribute to the life of the Honorable Carl
5555 E. F. Dally and extend sincere condolences to the members of his
5656 family: to his son, William Carl Dally, and daughter-in-law,
5757 Cindy Laguna Dally; to his granddaughter, Laura Dally Stowe, and
5858 her husband, Nathan Jay Stowe; to his great-granddaughter, Ella
5959 Frances Stowe; and to all others who mourn his passing; and, be it
6060 further
6161 RESOLVED, That an official copy of this Resolution be
6262 prepared for his family and that when the Texas Senate adjourns
6363 this day, it do so in memory of Judge Carl Dally.
