| 6 | 6 | | Legislature, Regular Session, 2023, That Senate Rule 12.03 be |

| 7 | 7 | | suspended in part as provided by Senate Rule 12.08 to enable the |

| 8 | 8 | | conference committee appointed to resolve the differences on |

| 9 | 9 | | Senate Bill 10 (certain benefits paid by the Teacher Retirement |

| 10 | 10 | | System of Texas) to consider and take action on the following |
|---|
| 11 | 11 | | matters: |
|---|
| 12 | 12 | | (1) Senate Rule 12.03(2) is suspended to permit the |
|---|
| 13 | 13 | | committee to omit text not in disagreement in proposed SECTION 1 |
|---|
| 14 | 14 | | of the bill, adding Section 824.703(a), Government Code, by |
|---|
| 15 | 15 | | striking "an additional" and substituting "a". |
|---|
| 16 | 16 | | Explanation: The change is necessary to remove unnecessary |
|---|
| 17 | 17 | | language. |
|---|
| 18 | 18 | | (2) Senate Rules 12.03(3) and (4), are suspended to |
|---|
| 19 | 19 | | permit the committee to add text on a matter not in disagreement |
|---|
| 20 | 20 | | and not included in either the house or senate version of the bill |

| 21 | 21 | | in proposed SECTION 1 of the bill, by adding Section |

| 22 | 22 | | 824.703(c)(3), Government Code, to read as follows: |

| 23 | 23 | | (3) is an alternate payee under Section 804.005, to |

| 24 | 24 | | be eligible for the adjustment: |
|---|

|---|
| 26 | 26 | | effective date of the adjustment; and |

| 27 | 27 | | (B) the effective date of the annuitant's |
|---|
| 28 | 28 | | election to receive the annuity payment was on or before August |

| 29 | 29 | | 31, 2020. |

| 30 | 30 | | Explanation: The change is necessary to clarify that an |

| 31 | 31 | | alternate payee makes the election and specify that an alternate |
|---|
| 32 | 32 | | payee must be living on the effective date of the cost-of-living |

| 40 | 40 | | age on any day of the calendar month before the calendar month in |

| 41 | 41 | | which the Teacher Retirement System of Texas issues the |

| 42 | 42 | | supplemental payment; or |
|---|
| 43 | 43 | | (2) $2,400, if the annuitant is: |

| 44 | 44 | | (A) at least 70 years of age but younger than |
|---|
| 45 | 45 | | 75 years of age on any day of the calendar month before the |
|---|
| 46 | 46 | | calendar month in which the Teacher Retirement System of Texas |
|---|
| 47 | 47 | | issues the supplemental payment; and |
|---|
| 48 | 48 | | (B) not subject to Subdivision (1) of this |
|---|
| 49 | 49 | | subsection. |

| 50 | 50 | | Explanation: The change is necessary to prescribe |
|---|
| 51 | 51 | | different amounts for the supplemental payment required by the |
|---|
| 52 | 52 | | proposed bill based on the age of the annuitant eligible for the |
|---|
