44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 88th
66 Legislature, Regular Session, 2023, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill 10 (certain benefits paid by the Teacher Retirement
1010 System of Texas) to consider and take action on the following
1111 matters:
1212 (1) Senate Rule 12.03(2) is suspended to permit the
1313 committee to omit text not in disagreement in proposed SECTION 1
1414 of the bill, adding Section 824.703(a), Government Code, by
1515 striking "an additional" and substituting "a".
1616 Explanation: The change is necessary to remove unnecessary
1717 language.
1818 (2) Senate Rules 12.03(3) and (4), are suspended to
1919 permit the committee to add text on a matter not in disagreement
2020 and not included in either the house or senate version of the bill
2121 in proposed SECTION 1 of the bill, by adding Section
2222 824.703(c)(3), Government Code, to read as follows:
2323 (3) is an alternate payee under Section 804.005, to
2424 be eligible for the adjustment:
2525 (A) the annuitant must be living on the
2626 effective date of the adjustment; and
2727 (B) the effective date of the annuitant's
2828 election to receive the annuity payment was on or before August
2929 31, 2020.
3030 Explanation: The change is necessary to clarify that an
3131 alternate payee makes the election and specify that an alternate
3232 payee must be living on the effective date of the cost-of-living
3333 adjustment required by the proposed bill.
3434 (3) Senate Rules 12.03(3) and (4), are suspended to
3535 permit the committee to add text on a matter not in disagreement
3636 and not included in either the house or senate version of the bill
3737 by adding proposed SECTION 2(c) of the bill to read as follows:
3838 (c) The amount of the supplemental payment is equal to:
3939 (1) $7,500, if the annuitant is at least 75 years of
4040 age on any day of the calendar month before the calendar month in
4141 which the Teacher Retirement System of Texas issues the
4242 supplemental payment; or
4343 (2) $2,400, if the annuitant is:
4444 (A) at least 70 years of age but younger than
4545 75 years of age on any day of the calendar month before the
4646 calendar month in which the Teacher Retirement System of Texas
4747 issues the supplemental payment; and
4848 (B) not subject to Subdivision (1) of this
4949 subsection.
5050 Explanation: The change is necessary to prescribe
5151 different amounts for the supplemental payment required by the
5252 proposed bill based on the age of the annuitant eligible for the
5353 payment.
