56 BE IT RESOLVED by the Senate of the State of Texas, 88th
67 Legislature, Regular Session, 2023, That Senate Rule 12.03 be
78 suspended in part as provided by Senate Rule 12.08 to enable the
8- conference committee appointed to resolve the differences on
9- Senate Bill 12 (the authority to regulate sexually oriented
10- performances and to restricting those performances on the
11- premises of a commercial enterprise, on public property, or in
12- the presence of an individual younger than 18 years of age;
13- authorizing a civil penalty; creating a criminal offense) to
14- consider and take action on the following matter:
15- Senate Rule 12.03(4) is suspended to permit the committee
16- to add text on a matter not included in either the house or senate
9+ conference committee appointed to resolve the differences on Senate
10+ Bill 12 (the authority to regulate sexually oriented performances
11+ and to restricting those performances on the premises of a
12+ commercial enterprise, on public property, or in the presence of an
13+ individual younger than 18 years of age; authorizing a civil
14+ penalty; creating a criminal offense) to consider and take action
15+ on the following matter:
16+ Senate Rule 12.03(4) is suspended to permit the committee to
17+ add text on a matter not included in either the house or senate
1718 version of the bill in proposed SECTION 3 of the bill, by adding
1819 Section 43.28(a)(1)(E), Penal Code, to read as follows:
1920 (E) the exhibition of sexual gesticulations
2021 using accessories or prosthetics that exaggerate male or female
2122 sexual characteristics
2223 Explanation: The change is necessary to add additional
2324 conduct to the definition of sexual conduct.
