5+ R E S O L U T I O N
56 BE IT RESOLVED by the Senate of the State of Texas, 88th
67 Legislature, Regular Session, 2023, That Senate Rule 12.03 be
78 suspended in part as provided by Senate Rule 12.08 to enable the
8- conference committee appointed to resolve the differences on
9- House Bill 357 (the requirements to access the online tracker of
10- an application for a ballot to be voted by mail and to the date of
9+ conference committee appointed to resolve the differences on House
10+ Bill 357 (the requirements to access the online tracker of an
11+ application for a ballot to be voted by mail and to the date of
1112 runoff elections) to consider and take action on the following
1213 matter:
13- Senate Rule 12.03(4) is suspended to permit the committee
14- to add text on a matter not included in either the house or senate

1516 version of the bill by adding the following SECTIONS to the bill:
1617 SECTION 1. Section 2.025, Election Code, is amended by
1718 amending Subsection (a) and adding Subsection (e) to read as

1920 (a) Except as provided by Subsection (d) or as otherwise
20- provided by this code, a runoff election shall be held on a
21- Saturday designated by the secretary of state [not earlier than
22- the 20th or later than the 45th day after the date the final
23- canvass of the main election is completed].
24- (e) A date designated by the secretary of state under
25- this section for a runoff election:
21+ provided by this code, a runoff election shall be held on a Saturday
22+ designated by the secretary of state [not earlier than the 20th or
23+ later than the 45th day after the date the final canvass of the main
24+ election is completed].
25+ (e) A date designated by the secretary of state under this
26+ section for a runoff election:
2627 (1) must be:
27- (A) not earlier than the 30th day after the
28- date of the main election; and
29- (B) not later than the 45th day after the date

3132 (2) may not:
32- (A) be a national or state holiday under

36+ national or state holiday under Section 1.006(f).
3637 SECTION 3. Section 2.025(b), Election Code, is repealed.
3738 Explanation: This change is necessary to provide for
38- consistency and predictability in determining the date of a
39- runoff election.
