55 AN ACT
66 relating to the employment and licensing of border security
77 officers employed by the Department of Public Safety.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 411, Government Code, is
1010 amended by adding Section 411.02091 to read as follows:
1111 Sec. 411.02091. BORDER SECURITY OFFICERS. (a) The
1212 department may employ as a border security officer to assist
1313 department efforts along the Texas-Mexico border an individual who:
1414 (1) has served in the United States armed forces and
1515 received an honorable discharge; and
1616 (2) holds a border security officer license issued by
1717 the Texas Commission on Law Enforcement.
1818 (b) The department shall develop a training program for
1919 border security officers that complies with the requirements of
2020 Subchapter P, Chapter 1701, Occupations Code.
2121 (c) The department shall deploy border security officers to
2222 serve along the Texas-Mexico border for 60 continuous days out of a
2323 90-day period.
2424 SECTION 2. Chapter 1701, Occupations Code, is amended by
2525 adding Subchapter P to read as follows:
2626 SUBCHAPTER P. BORDER SECURITY OFFICERS
2727 Sec. 1701.751. BORDER SECURITY OFFICER LICENSE. (a) The
2828 commission shall adopt rules establishing a border security officer
2929 license for border security officers of the Department of Public
3030 Safety.
3131 (b) The rules adopted under Subsection (a) must provide for
3232 an application process for a border security officer license that
3333 is similar to the application process for a peace officer license.
3434 Sec. 1701.752. ELIGIBILITY. A border security officer
3535 license may be issued only to an individual who served in the United
3636 States armed forces and received an honorable discharge and
3737 satisfies the eligibility requirements established by commission
3838 rule.
3939 Sec. 1701.753. REQUIRED TRAINING. The commission, in
4040 consultation with the Department of Public Safety, shall establish
4141 training requirements for border security officers.
4242 Sec. 1701.754. AUTHORITY OF BORDER SECURITY OFFICER. (a)
4343 An individual who holds a border security officer license has the
4444 same authority as a peace officer except as otherwise provided by
4545 commission rule.
4646 (b) The commission, in consultation with the Department of
4747 Public Safety, shall adopt rules to implement this section.
4848 SECTION 3. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect on the 91st day after the last day of the
5353 legislative session.
