55 AN ACT
66 relating to bond requirements for certain judges.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 25.0006(a-1) and (a-4), Government
99 Code, are amended to read as follows:
1010 (a-1) Before beginning the duties of the office, the judge
1111 of a statutory county court must execute a bond that:
1212 (1) is payable to the treasurer of the county;
1313 (2) is in the amount set by the commissioners court of:
1414 (A) subject to Paragraph (B), not less than
1515 $1,000 nor more than $10,000; or
1616 (B) for a judge presiding in the court over
1717 guardianship proceedings, as defined by Section 1002.015, Estates
1818 Code, or over probate proceedings, as defined by Section 22.029,
1919 Estates Code, not less than $500,000[:
2020 [(i) $100,000 for a court in a county with a
2121 population of 125,000 or less; or
2222 [(ii) $250,000 for a court in a county with
2323 a population of more than 125,000]; and
2424 (3) is conditioned that the judge will:
2525 (A) faithfully perform all duties of office; and
2626 (B) for a judge presiding in the court over
2727 guardianship or probate proceedings, perform the duties required by
2828 the Estates Code.
2929 (a-4) This section does not apply to:
3030 (1) [a judge of a statutory county court who does not
3131 preside over guardianship proceedings, as defined by Section
3232 1002.015, Estates Code;
3333 [(2)] a judge of a statutory probate court who
3434 executes a bond, obtains insurance, or self-insures pursuant to
3535 Section 25.00231; or
3636 (2) [(3)] a judge who presides over a county criminal
3737 court.
3838 SECTION 2. Section 26.001(a), Government Code, is amended
3939 to read as follows:
4040 (a) Before beginning the duties of the office, the county
4141 judge must execute a bond that:
4242 (1) is payable to the treasurer of the county;
4343 (2) is in the amount set by the commissioners court of:
4444 (A) subject to Paragraph (B), not less than
4545 $1,000 nor more than $10,000; or
4646 (B) for a county judge presiding in the county
4747 court over guardianship proceedings, as defined by Section
4848 1002.015, Estates Code, or over probate proceedings, as defined by
4949 Section 22.029, Estates Code, not less than $500,000[:
5050 [(i) $100,000 for a court in a county with a
5151 population of 125,000 or less; or
5252 [(ii) $250,000 for a court in a county with
5353 a population of more than 125,000]; and
5454 (3) is conditioned that the judge will:
5555 (A) faithfully perform all duties of office; and
5656 (B) for a county judge presiding in the county
5757 court over guardianship or probate proceedings, perform the duties
5858 required by the Estates Code.
5959 SECTION 3. This Act takes effect September 1, 2023.
