44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prohibiting the transfer of certain semiautomatic
77 rifles to certain recipients; creating a criminal offense;
88 increasing a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.06, Penal Code, is amended by
1111 amending Subsections (a), (c), and (d) and adding Subsection (c-1)
1212 to read as follows:
1313 (a) A person commits an offense if the person:
1414 (1) sells, rents, leases, loans, or gives a handgun to
1515 any person knowing that the person to whom the handgun is to be
1616 delivered intends to use it unlawfully or in the commission of an
1717 unlawful act;
1818 (2) intentionally or knowingly sells, rents, leases,
1919 or gives or offers to sell, rent, lease, or give:
2020 (A) to a [any] child younger than 18 years of age
2121 a [any firearm,] club, [or] location-restricted knife, or firearm
2222 other than a semiautomatic rifle described by Paragraph (B); or
2323 (B) to a person younger than 21 years of age a
2424 semiautomatic rifle that is capable of accepting a detachable
2525 magazine and that has a caliber greater than .22;
2626 (3) intentionally, knowingly, or recklessly sells a
2727 firearm or ammunition for a firearm to any person who is
2828 intoxicated;
2929 (4) knowingly sells a firearm or ammunition for a
3030 firearm to any person who has been convicted of a felony before the
3131 fifth anniversary of the later of the following dates:
3232 (A) the person's release from confinement
3333 following conviction of the felony; or
3434 (B) the person's release from supervision under
3535 community supervision, parole, or mandatory supervision following
3636 conviction of the felony;
3737 (5) sells, rents, leases, loans, or gives a handgun to
3838 any person knowing that an active protective order is directed to
3939 the person to whom the handgun is to be delivered;
4040 (6) knowingly purchases, rents, leases, or receives as
4141 a loan or gift from another a handgun while an active protective
4242 order is directed to the actor; or
4343 (7) while prohibited from possessing a firearm under
4444 state or federal law, knowingly makes a material false statement on
4545 a form that is:
4646 (A) required by state or federal law for the
4747 purchase, sale, or other transfer of a firearm; and
4848 (B) submitted to a [licensed] firearms dealer
4949 licensed under[, as defined by] 18 U.S.C. Section 923.
5050 (c) It is an affirmative defense to prosecution under
5151 Subsection (a)(2)(A) [(a)(2)] that the transfer was to a minor
5252 whose parent or the person having legal custody of the minor had
5353 given written permission for the sale or, if the transfer was other
5454 than a sale, the parent or person having legal custody had given
5555 effective consent.
5656 (c-1) It is an exception to the application of Subsection
5757 (a)(2)(B) that:
5858 (1) the semiautomatic rifle is transferred to a
5959 recipient who:
6060 (A) is a peace officer; or
6161 (B) is currently serving in or has been honorably
6262 discharged from the United States armed forces; or
6363 (2) the transfer of the semiautomatic rifle is a
6464 temporary loan to a person who is to carry or use the semiautomatic
6565 rifle only:
6666 (A) while in the presence of the transferor;
6767 (B) while on property owned or leased by the
6868 transferor;
6969 (C) on the premises of a sport shooting range, as
7070 defined by Section 250.001, Local Government Code, and solely for
7171 the purpose of shooting targets at the range; or
7272 (D) at a lawful competition involving the use of
7373 a firearm.
7474 (d) An offense under this section is a Class A misdemeanor,
7575 except that:
7676 (1) an offense under Subsection (a)(2)(A) [(a)(2)] is
7777 a state jail felony if the weapon that is the subject of the offense
7878 is a handgun; and
7979 (2) an offense under Subsection (a)(2)(B) or (a)(7) is
8080 a state jail felony.
8181 SECTION 2. The change in law made by this Act applies only
8282 to an offense committed on or after the effective date of this Act.
8383 An offense committed before the effective date of this Act is
8484 governed by the law in effect on the date the offense was committed,
8585 and the former law is continued in effect for that purpose. For
8686 purposes of this section, an offense was committed before the
8787 effective date of this Act if any element of the offense occurred
8888 before that date.
8989 SECTION 3. To the extent of any conflict, this Act prevails
9090 over another Act of the 88th Legislature, Regular Session, 2023,
9191 relating to nonsubstantive additions to and corrections in enacted
9292 codes.
9393 SECTION 4. This Act takes effect September 1, 2023.
