44 SENATE CONCURRENT RESOLUTION
55 WHEREAS, Transnational cartels are exploiting weak and
66 unsecure points along the United States Southern Border to expand
77 their criminal enterprises and terrorize Americans; and
88 WHEREAS, 379 million deadly doses of fentanyl were seized by
99 U.S. authorities in 2022, enough to kill every American man, woman,
1010 and child; and
1111 WHEREAS, The State of Texas is charged with protecting its
1212 citizens and is empowered to defend itself against invasion under
1313 Article 1, Section 10 of the United States Constitution;
1414 WHEREAS, Article IV, Section 7 of the Texas Constitution
1515 states that the Governor of Texas "shall be Commander-in-Chief of
1616 the military forces of the State" and has the power to organize
1717 armed forces to "repel invasions"; and
1818 WHEREAS, The United States Federal Government is charged, in
1919 the United States Constitution, to "provide for the common defense"
2020 and protect its States "against invasion" under the Preamble and
2121 Article IV, Section 4, respectively; and
2222 WHEREAS, The State of Texas has spent $4 billion on border
2323 initiatives in the 2021-2022 biennium, investing in
2424 state-of-the-art detection equipment, a border wall, and calling up
2525 tens of thousands of members of National and State Guard units;
2626 WHEREAS, Operation Lone Star's multi-agency effort has led to
2727 over 352,000 illegal immigrant apprehensions and more than 23,000
2828 criminal arrests; and
2929 WHEREAS, Both human and drug trafficking by transnational
3030 cartels have created a security threat and humanitarian disaster by
3131 terrorizing residents of the United States and the State of Texas;
3232 and
3333 WHEREAS, Four United States citizens were kidnapped by a
3434 cartel abroad in early March, two of them brutally murdered.
3535 Unfortunately, the tragic incident was not isolated, and violence
3636 permeates any area these transnational cartels inhabit; and
3737 WHEREAS, The continual violation of Texas's sovereignty and
3838 territorial integrity has resulted in reports of residents of Texas
3939 being assaulted, threatened with violence, and robbed; now,
4040 therefore, be it
4141 RESOLVED, That the 88th Legislature of the State of Texas
4242 hereby declare an invasion by transnational cartel terrorists under
4343 Article 1, Section 10 of the United States Constitution and Article
4444 IV, Section 7 of the Texas Constitution; and, be it further
4545 RESOLVED, That the Legislature ask Governor Abbott to
4646 accelerate the construction of a wall along the Southern Border,
4747 utilizing Eminent Domain where necessary, to prevent the entrance
4848 of transnational cartels into the state; and, be it further
4949 RESOLVED, That the Legislature demand that the U.S. Congress
5050 recognize its obligation under the U.S. Constitution to "provide
5151 for the common defense" by voting to deploy U.S. military forces to
5252 combat transnational cartels; and, be it further
5353 RESOLVED, That the Legislature demand that the federal
5454 government allocate more financial support to Texas' border
5555 security wall and reimburse Texas for past expenditures on security
5656 efforts to repel invaders at its Southern Border; and, be it further
5757 RESOLVED, That the Texas Secretary of State forward official
5858 copies of this resolution to the President of the United States, to
5959 the President of the Senate and the Speaker of the House of
6060 Representatives of the United States Congress, and to all members
6161 of the Texas delegation to Congress with the request that this
6262 resolution be officially entered in the Congressional Record as a
6363 memorial to the Congress of the United States of America.
