55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to protections for certain military dependents enrolled in
88 a public school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 25, Education Code, is
1111 amended by adding Section 25.906 to read as follows:
1212 Sec. 25.906. PROTECTIONS FOR CERTAIN MILITARY DEPENDENTS.
1313 (a) In this section:
1414 (1) "Compact" means the Interstate Compact on
1515 Educational Opportunity for Military Children entered into under
1616 Section 162.002.
1717 (2) "Uniformed services" means:
1818 (A) the United States Army, Navy, Air Force,
1919 Space Force, Marine Corps, or Coast Guard;
2020 (B) the Commissioned Corps of the National
2121 Oceanic and Atmospheric Administration; or
2222 (C) the Commissioned Corps of the United States
2323 Public Health Service.
2424 (b) The provisions of Articles IV, V, VI, and VII of the
2525 compact apply to the following children as if those children were
2626 children described by Article III of the compact:
2727 (1) a child of a veteran of the uniformed services who
2828 was discharged or released through retirement, for a period of four
2929 years after the date of the veteran's retirement, if the veteran
3030 returns to the veteran's home of record on military orders; and
3131 (2) a child of a member of the uniformed services who
3232 dies while on active duty or as a result of injuries sustained while
3333 on active duty, for a period of four years after the member's death.
3434 (c) Each school district and open-enrollment charter school
3535 that maintains an Internet website shall post on the district's or
3636 school's Internet website an easily accessible link to information
3737 regarding the compact and the additional protections provided by
3838 this section.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect on the 91st day after the last day of the
4444 legislative session.
