55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the sale of charitable raffle tickets by certain
88 nonprofit wildlife conservation associations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2002.054, Occupations Code, is amended
1111 by amending Subsection (a) and adding Subsection (a-1) to read as
1212 follows:
1313 (a) The organization may not:
1414 (1) directly or indirectly, by the use of paid
1515 advertising, promote a raffle through a medium of mass
1616 communication, including television, radio, or newspaper;
1717 (2) promote or advertise a raffle statewide, other
1818 than on the organization's Internet website or through a
1919 publication or solicitation, including a newsletter, social media,
2020 or electronic mail, provided only to previously identified
2121 supporters of the organization; or
2222 (3) sell or offer to sell tickets for a raffle
2323 statewide, except as provided by Subsection (a-1).
2424 (a-1) A nonprofit wildlife conservation association,
2525 including each local chapter, affiliate, wildlife cooperative, or
2626 unit, that for purposes of this chapter is a qualified nonprofit
2727 organization eligible under Section 2002.003(e), may use the
2828 organization's Internet website to sell or offer to sell tickets
2929 for a raffle to previously identified supporters of the
3030 organization. This subsection does not authorize the use of an
3131 Internet website to:
3232 (1) provide a graphic or dynamic animation of an entry
3333 to a raffle; or
3434 (2) provide a graphic or dynamic animation of the
3535 drawing of raffle tickets.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect on the 91st day after the last day of the
4141 legislative session.
