55 A JOINT RESOLUTION
66 proposing a constitutional amendment excepting certain
77 appropriations to pay for school district ad valorem tax relief
88 from the constitutional limitation on the rate of growth of
99 appropriations.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 22, Article VIII, Texas Constitution, is
1212 amended by adding Subsection (a-1) to read as follows:
1313 (a-1) Appropriations from state tax revenues not dedicated
1414 by this constitution that are made for the purpose of paying for
1515 school district ad valorem tax relief as identified by the
1616 legislature by general law are not included as appropriations for
1717 purposes of determining whether the rate of growth of
1818 appropriations exceeds the limitation prescribed by Subsection (a)
1919 of this section.
2020 SECTION 2. The following temporary provision is added to
2121 the Texas Constitution:
2222 TEMPORARY PROVISION. (a) This temporary provision applies
2323 to the amendment to Section 22, Article VIII, of this constitution
2424 as proposed by the 88th Legislature, 2nd Called Session, 2023,
2525 excepting certain appropriations to pay for school district ad
2626 valorem tax relief from the constitutional limitation on the rate
2727 of growth of appropriations.
2828 (b) The change made to Section 22, Article VIII, of this
2929 constitution by the amendment applies to appropriations made for
3030 the state fiscal biennium beginning September 1, 2023, and
3131 subsequent state fiscal bienniums.
3232 (c) This temporary provision expires September 1, 2025.
3333 SECTION 3. This proposed constitutional amendment shall be
3434 submitted to the voters at an election to be held November 7, 2023.
3535 The ballot shall be printed to provide for voting for or against the
3636 proposition: "The constitutional amendment excepting certain
3737 appropriations to pay for school district property tax relief from
3838 the constitutional limitation on the rate of growth of
3939 appropriations."
