44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to certain information required to be posted by a school
77 district on the school district's Internet website.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 44, Education Code, is
1010 amended by adding Section 44.012 to read as follows:
1111 Sec. 44.012. POSTING ON WEBSITE OF INFORMATION REGARDING
1212 SOURCES AND USES OF MAINTENANCE AND OPERATIONS REVENUE. (a) This
1313 subsection applies only to a school district that has a wealth per
1414 student that exceeds the amount specified by Section 41.002(a)(1)
1515 and that, for the school year beginning in the current tax year, has
1616 entered into an agreement with the commissioner to purchase average
1717 daily attendance credits as provided by Subchapter D, Chapter 41,
1818 in an amount sufficient, in combination with any other actions
1919 taken under that chapter, to reduce the school district's wealth
2020 per student to a level that is equal to or less than the equalized
2121 wealth level as determined by the commissioner under that chapter.
2222 If the school district maintains a generally accessible Internet
2323 website, the school district shall post on the website:
2424 (1) the percentage of the taxes for maintenance and
2525 operations imposed by the school district for the current tax year
2626 that the school district is required to pay under the agreement for
2727 the school year beginning in the current tax year to purchase
2828 average daily attendance credits; and
2929 (2) the percentage of the taxes for maintenance and
3030 operations imposed by the school district for the current tax year
3131 that the school district is not required to pay under the agreement
3232 for the school year beginning in the current tax year to purchase
3333 average daily attendance credits.
3434 (b) This subsection applies only to a school district to
3535 which Subsection (a) does not apply. If the school district
3636 maintains a generally accessible Internet website, the school
3737 district shall post on the website:
3838 (1) the percentage of the maintenance and operations
3939 revenue of the school district for the school year beginning in the
4040 current tax year that is derived from taxes for maintenance and
4141 operations imposed by the school district for the current tax year;
4242 (2) the percentage of the maintenance and operations
4343 revenue of the school district for the school year beginning in the
4444 preceding tax year that was derived from taxes for maintenance and
4545 operations imposed by the school district for the preceding tax
4646 year;
4747 (3) the percentage of the maintenance and operations
4848 revenue of the school district for the school year beginning in the
4949 current tax year that is derived from state funds distributed to the
5050 school district; and
5151 (4) the percentage of the maintenance and operations
5252 revenue of the school district for the school year beginning in the
5353 preceding tax year that was derived from state funds distributed to
5454 the school district.
5555 SECTION 2. This Act takes effect January 1, 2024.
