55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to border protection agreements between this state and the
88 United Mexican States.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 ARTICLE 1. LEGISLATIVE FINDING
1111 SECTION 1.01. (a) The legislature, acting with the
1212 governor, has the solemn duty to protect and defend the citizens of
1313 this state and maintain sovereignty over this state's borders.
1414 (b) An individual entering this state from a foreign country
1515 shall enter through a legal port of entry.
1616 ARTICLE 2. BORDER PROTECTION AGREEMENTS
1717 SECTION 2.01. Title 7, Government Code, is amended by
1818 adding Chapter 795 to read as follows:
1919 CHAPTER 795. BORDER PROTECTION AGREEMENTS WITH UNITED MEXICAN
2020 STATES
2121 Sec. 795.001. AUTHORITY FOR AGREEMENTS AND ENGAGEMENT WITH
2222 AUTHORITIES OF UNITED MEXICAN STATES. (a) On behalf of this state,
2323 the governor shall coordinate, develop, and execute agreements with
2424 the United Mexican States and the states of the United Mexican
2525 States regarding the authority of this state to protect and defend
2626 its citizens.
2727 (b) The governor may appoint a group of individuals
2828 responsible for meeting in person with the appropriate local,
2929 state, and federal authorities of the United Mexican States to
3030 coordinate, develop, and execute agreements under Subsection (a).
3131 The group appointed under this subsection may operate within the
3232 United Mexican States as practicable.
3333 ARTICLE 3. EFFECTIVE DATE
3434 SECTION 3.01. This Act takes effect immediately if it
3535 receives a vote of two-thirds of all the members elected to each
3636 house, as provided by Section 39, Article III, Texas Constitution.
3737 If this Act does not receive the vote necessary for immediate
3838 effect, this Act takes effect on the 91st day after the last day of
3939 the legislative session.
