6 | 6 | | relating to the authority of a political subdivision to use public |

7 | 7 | | money to provide legal services for individuals unlawfully present |

8 | 8 | | in the United States. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 140, Local Government Code, is amended |
---|
11 | 11 | | by adding Section 140.014 to read as follows: |
---|
12 | 12 | | Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE |
---|
13 | 13 | | LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required |
---|
14 | 14 | | by the United States Constitution, a political subdivision may not: |
---|
15 | 15 | | (1) use public money to provide legal services for an |
---|
16 | 16 | | individual who is unlawfully present in the United States according |
---|
17 | 17 | | to the terms of the federal Immigration and Nationality Act (8 |
---|
18 | 18 | | U.S.C. Section 1101 et seq.); or |
---|
19 | 19 | | (2) provide public money to a person to be used to |
---|
20 | 20 | | directly or indirectly provide legal services for an individual |
---|
21 | 21 | | described by Subdivision (1). |
---|
22 | 22 | | SECTION 2. This Act takes effect on the 91st day after the |
---|
23 | 23 | | last day of the legislative session. |
