44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the authority of a political subdivision to use public
77 money to provide legal services for individuals unlawfully present
88 in the United States.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 140, Local Government Code, is amended
1111 by adding Section 140.014 to read as follows:
1212 Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE
1313 LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required
1414 by the United States Constitution, a political subdivision may not:
1515 (1) use public money to provide legal services for an
1616 individual who is unlawfully present in the United States according
1717 to the terms of the federal Immigration and Nationality Act (8
1818 U.S.C. Section 1101 et seq.); or
1919 (2) provide public money to a person to be used to
2020 directly or indirectly provide legal services for an individual
2121 described by Subdivision (1).
2222 SECTION 2. This Act takes effect on the 91st day after the
2323 last day of the legislative session.
