44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the recipients and subrecipients of financial
77 assistance administered by the Texas Department of Housing and
88 Community Affairs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.111, Government Code, is amended by
1111 adding Subsection (j) to read as follows:
1212 (j) The department by rule shall adopt policies to ensure
1313 that each recipient or subrecipient of financial assistance
1414 administered by the department, including financial assistance
1515 from the proceeds of bonds issued by the department, is:
1616 (1) a citizen of the United States; or
1717 (2) authorized to be present in the United States by
1818 the United States agency responsible for citizenship and
1919 immigration.
2020 SECTION 2. (a) The change in law made by this Act in adding
2121 Section 2306.111(j), Government Code, applies only to an
2222 application for financial assistance that is submitted to the Texas
2323 Department of Housing and Community Affairs on or after January 1,
2424 2024. An application for financial assistance that is submitted to
2525 the department before January 1, 2024, is governed by the law in
2626 effect when the application was submitted, and the former law is
2727 continued in effect for that purpose.
2828 (b) Not later than December 1, 2023, the Texas Department of
2929 Housing and Community Affairs shall adopt the rules required by
3030 Section 2306.111(j), Government Code, as added by this Act.
3131 SECTION 3. This Act takes effect on the 91st day after the
3232 last day of the legislative session.
