66 AN ACT
77 relating to permit fees for groundwater wells imposed by the
88 Southeast Texas Groundwater Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 8868.153, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 8868.153. PERMIT FEES. (a) The district by rule may
1313 impose a reasonable fee on each well that is not exempt from
1414 regulation by the district and for which a permit is issued by the
1515 district.
1616 (b) The fee must be based on the amount of water to be
1717 withdrawn from the well.
1818 (c) The fee may not exceed seven cents [one cent] per
1919 thousand gallons of groundwater withdrawn for any purpose.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect on the 91st day after the last day of the
2525 legislative session.
