| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 8868.153, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 8868.153. PERMIT FEES. (a) The district by rule may |
|---|
| 13 | 13 | | impose a reasonable fee on each well that is not exempt from |
|---|
| 14 | 14 | | regulation by the district and for which a permit is issued by the |
|---|
| 15 | 15 | | district. |
|---|
| 16 | 16 | | (b) The fee must be based on the amount of water to be |
|---|
| 17 | 17 | | withdrawn from the well. |
|---|
| 18 | 18 | | (c) The fee may not exceed seven cents [one cent] per |
|---|
| 19 | 19 | | thousand gallons of groundwater withdrawn for any purpose. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect on the 91st day after the last day of the |
|---|
| 25 | 25 | | legislative session. |
