55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the implementation of diversity, equity, and inclusion
88 initiatives by certain governmental entities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1111 by adding Chapter 621 to read as follows:
1212 CHAPTER 621. PROHIBITION ON CERTAIN DIVERSITY, EQUITY, AND
1313 INCLUSION INITIATIVES
1414 Sec. 621.001. DEFINITIONS. In this chapter:
1515 (1) "Diversity, equity, and inclusion office" means an
1616 office, division, or other unit of a governmental entity
1717 established for the purpose of:
1818 (A) influencing hiring or employment practices
1919 at the entity with respect to race, sex, color, or ethnicity, other
2020 than through the use of color-blind and sex-neutral hiring
2121 processes in accordance with any applicable state and federal
2222 antidiscrimination laws;
2323 (B) promoting differential treatment or
2424 providing special benefits to individuals on the basis of race,
2525 sex, color, or ethnicity;
2626 (C) promoting policies or procedures designed or
2727 implemented in reference to race, color, or ethnicity, other than
2828 policies or procedures implemented for the purpose of ensuring
2929 compliance with any applicable federal law; or
3030 (D) conducting trainings, programs, or
3131 activities designed or implemented in reference to race, color,
3232 ethnicity, gender identity, or sexual orientation, other than
3333 trainings, programs, or activities conducted for the purpose of
3434 ensuring compliance with any applicable court order or state or
3535 federal law.
3636 (2) "Governmental entity" has the meaning assigned by
3737 Section 620.001, Government Code, except that the term also
3838 includes a school district or open-enrollment charter school.
3939 Sec. 621.002. APPLICABILITY OF CHAPTER. This chapter does
4040 not apply to an institution of higher education.
4141 Sec. 621.003. RESPONSIBILITY OF GOVERNMENTAL ENTITY
4242 REGARDING DIVERSITY, EQUITY, AND INCLUSION INITIATIVES. (a) A
4343 governmental entity shall ensure that each unit of the entity:
4444 (1) does not, except as required by federal law:
4545 (A) establish or maintain a diversity, equity,
4646 and inclusion office;
4747 (B) hire or assign an employee of the entity or
4848 contract with a third party to perform the duties of a diversity,
4949 equity, and inclusion office;
5050 (C) compel, require, induce, or solicit any
5151 person to provide a diversity, equity, and inclusion statement or
5252 give preferential consideration to any person based on the
5353 provision of a diversity, equity, and inclusion statement;
5454 (D) give preference on the basis of race, sex,
5555 color, ethnicity, or national origin to an applicant for
5656 employment, an employee, or a participant in any function of the
5757 entity; or
5858 (E) require as a condition of employment any
5959 person to participate in diversity, equity, and inclusion training,
6060 which:
6161 (i) includes a training, program, or
6262 activity designed or implemented in reference to race, color,
6363 ethnicity, gender identity, or sexual orientation; and
6464 (ii) does not include a training, program,
6565 or activity developed for the purpose of ensuring compliance with
6666 any applicable federal law; and
6767 (2) adopts policies and procedures for appropriately
6868 disciplining, including by termination, an employee or contractor
6969 of the entity who engages in conduct in violation of Subdivision
7070 (1).
7171 (b) Subsection (a)(1) may not be construed to apply to:
7272 (1) academic course instruction;
7373 (2) scholarly research or a creative work by a school
7474 district's or open-enrollment charter school's students or faculty;
7575 (3) an activity of a student organization registered
7676 with or recognized by a school district or open-enrollment charter
7777 school;
7878 (4) guest speakers or performers on short-term
7979 engagements;
8080 (5) a program or activity to enhance student academic
8181 achievement or postgraduate outcomes that allows participation
8282 without regard to race, sex, color, or ethnicity; or
8383 (6) data collection.
8484 (c) An employee of a governmental entity who is required to
8585 participate in training in violation of Subsection (a)(1)(E) may
8686 bring an action against the entity for injunctive and declaratory
8787 relief.
8888 SECTION 2. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect on the 91st day after the last day of the
9393 legislative session.
