55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of "eligible school district" for
88 purposes of the study of school district property values conducted
99 by the comptroller of public accounts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 403.3011(2), Government Code, is amended
1212 to read as follows:
1313 (2) "Eligible school district" means a school district
1414 for which the comptroller has determined the following:
1515 (A) in the most recent study, the local value is
1616 invalid under Section 403.302(c) and does not exceed the state
1717 value for the school district determined in the study; and
1818 (B) in the two studies preceding the most recent
1919 study, the school district's local value was valid under Section
2020 403.302(c)[;
2121 [(C) in the most recent study, the aggregate
2222 local value of all of the categories of property sampled by the
2323 comptroller is not less than 90 percent of the lower limit of the
2424 margin of error as determined by the comptroller of the aggregate
2525 value as determined by the comptroller of all of the categories of
2626 property sampled by the comptroller; and
2727 [(D) the appraisal district that appraises
2828 property for the school district was in compliance with the scoring
2929 requirement of the comptroller's most recent review of the
3030 appraisal district conducted under Section 5.102, Tax Code].
3131 SECTION 2. The change in law made by this Act applies only
3232 to a study conducted under Section 403.302, Government Code, for a
3333 tax year that begins on or after January 1, 2024. A study conducted
3434 before that date is governed by the law in effect immediately before
3535 the effective date of this Act, and the former law is continued in
3636 effect for that purpose.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect on the 91st day after the last day of the
4242 legislative session.
