44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the duties of a public school counselor.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 33.006(a) and (b), Education Code, are
99 amended to read as follows:
1010 (a) The primary responsibility of a school counselor is to
1111 counsel students to fully develop each student's academic, career,
1212 and personal[, and social] abilities.
1313 (b) In addition to a school counselor's responsibility
1414 under Subsection (a), the school counselor shall:
1515 (1) participate in planning, implementing, and
1616 evaluating a comprehensive developmental school counseling
1717 [guidance] program to serve all students and to address the special
1818 needs of students:
1919 (A) who are at risk of dropping out of school,
2020 becoming substance abusers, participating in gang activity, or
2121 committing suicide;
2222 (B) who are at risk of:
2323 (i) choosing an unhealthy or inappropriate
2424 solution to a problem; or
2525 (ii) engaging in harmful behavior toward
2626 the student's self or others;
2727 (C) who are in need of modified instructional
2828 strategies; or
2929 (D) [(C)] who are gifted and talented, with
3030 emphasis on identifying and serving gifted and talented students
3131 who are educationally disadvantaged;
3232 (2) consult with a student's parent or guardian and
3333 make referrals as appropriate in consultation with the student's
3434 parent or guardian;
3535 (3) consult with school staff, parents, and other
3636 community members to help them increase the effectiveness of
3737 student education and promote student success;
3838 (4) coordinate people and resources in the school,
3939 home, and community;
4040 (5) with the assistance of school staff, interpret
4141 standardized test results and other assessment data that help a
4242 student make educational and career plans;
4343 (6) deliver classroom guidance activities or serve as
4444 a consultant to teachers conducting lessons based on the school's
4545 guidance curriculum; and
4646 (7) serve as an impartial, nonreporting resource for
4747 interpersonal conflicts and discord involving two or more students,
4848 including accusations of bullying under Section 37.0832.
4949 SECTION 2. This Act applies beginning with the 2023-2024
5050 school year.
5151 SECTION 3. This Act takes effect on the 91st day after the
5252 last day of the legislative session.
