55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to procedural requirements for uranium mining production
88 area authorizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 27.0513(d), Water Code, is amended to
1111 read as follows:
1212 (d) Notwithstanding Sections 5.551, 5.556, 27.011, and
1313 27.018, an application for an authorization or an amendment to an
1414 authorization that allows the permit holder to conduct mining and
1515 restoration activities in production zones within the boundary
1616 established in the permit is an uncontested matter not subject to a
1717 contested case hearing or the hearing requirements of Chapter 2001,
1818 Government Code, if:
1919 (1) the authorization is for a production zone located
2020 within the boundary of a permit that incorporates, for each
2121 production zone addressed in the application, a range table of
2222 groundwater quality restoration values used to measure groundwater
2323 restoration by the commission;
2424 (2) the application includes, for each production zone
2525 addressed in the application, groundwater quality restoration
2626 values falling at or below the upper limit of the range established
2727 in Subdivision (1); and
2828 (3) the authorization is for a production zone located
2929 within the boundary of a permit that incorporates groundwater
3030 baseline characteristics of the wells for the application required
3131 by commission rule.
3232 SECTION 2. Sections 27.0513(f) and (g), Water Code, are
3333 repealed.
3434 SECTION 3. The change in law made by this Act applies only
3535 to an application for an authorization or an amendment to an
3636 authorization that is submitted to the Texas Commission on
3737 Environmental Quality on or after the effective date of this Act.
3838 An application for an authorization or an amendment to an
3939 authorization that was submitted to the commission before the
4040 effective date of this Act is governed by the law in effect at the
4141 time the application or amendment was submitted, and the former law
4242 is continued in effect for that purpose.
4343 SECTION 4. This Act takes effect on the 91st day after the
4444 last day of the legislative session.
