88 non-enrolled students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 33, Education Code, is
1111 amended by adding Section 33.023 to read as follows:
1212 Sec. 33.023. ACCESS TO SCHOOL LIBRARY MATERIALS BY
1313 NON-ENROLLED STUDENT. (a) In this section, "non-enrolled student"
1414 means a student who receives instruction as described by Section
1515 29.916(a)(1) from a nonpublic school.
1616 (b) The board of trustees of a school district and the
1717 governing body of an open-enrollment charter school shall adopt a
1818 policy allowing a non-enrolled student who resides in the district
1919 or in the geographic area served by the school to access the
2020 district's or school's library materials in the same manner that the
2121 district or school provides access to students enrolled in the
2222 district or school.
2323 (c) A policy adopted under Subsection (b) must require a
2424 non-enrolled student who seeks access to a school district's or
2525 open-enrollment charter school's library materials to establish
2626 minimum proof of residency.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect on the 91st day after the last day of the
3232 legislative session.
