| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 33, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 33.023 to read as follows: |
|---|
| 12 | 12 | | Sec. 33.023. ACCESS TO SCHOOL LIBRARY MATERIALS BY |
|---|
| 13 | 13 | | NON-ENROLLED STUDENT. (a) In this section, "non-enrolled student" |
|---|
| 14 | 14 | | means a student who receives instruction as described by Section |
|---|
| 15 | 15 | | 29.916(a)(1) from a nonpublic school. |
|---|
| 16 | 16 | | (b) The board of trustees of a school district and the |
|---|
| 17 | 17 | | governing body of an open-enrollment charter school shall adopt a |
|---|
| 18 | 18 | | policy allowing a non-enrolled student who resides in the district |
|---|
| 19 | 19 | | or in the geographic area served by the school to access the |
|---|
| 20 | 20 | | district's or school's library materials in the same manner that the |
|---|
| 21 | 21 | | district or school provides access to students enrolled in the |
|---|
| 22 | 22 | | district or school. |
|---|
| 23 | 23 | | (c) A policy adopted under Subsection (b) must require a |
|---|
| 24 | 24 | | non-enrolled student who seeks access to a school district's or |
|---|
| 25 | 25 | | open-enrollment charter school's library materials to establish |
|---|
| 26 | 26 | | minimum proof of residency. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect on the 91st day after the last day of the |
|---|
| 32 | 32 | | legislative session. |
