66 AN ACT
77 relating to the inclusion of a water conservation plan in a petition
88 filed with the Texas Commission on Environmental Quality requesting
99 the creation of a municipal utility district.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 54.015, Water Code, is amended to read as
1212 follows:
1313 Sec. 54.015. CONTENTS OF PETITION. The petition shall:
1414 (1) describe the boundaries of the proposed district
1515 by metes and bounds or by lot and block number, if there is a
1616 recorded map or plat and survey of the area;
1717 (2) state the general nature of the work proposed to be
1818 done, the necessity for the work, and the cost of the project as
1919 then estimated by those filing the petition; [and]
2020 (3) include a water conservation plan that meets the
2121 requirements of Section 13.146, regardless of whether that section
2222 applies to the district; and
2323 (4) include a name of the district which shall be
2424 generally descriptive of the locale of the district followed by the
2525 words Municipal Utility District, or if a district is located
2626 within one county, it may be designated "__________ County
2727 Municipal Utility District No. ______." (Insert the name of the
2828 county and proper consecutive number.) The proposed district shall
2929 not have the same name as any other district in the same county.
3030 SECTION 2. This Act applies only to a petition requesting
3131 the creation of a municipal utility district that is filed with the
3232 Texas Commission on Environmental Quality on or after the effective
3333 date of this Act. A petition requesting the creation of a municipal
3434 utility district that was filed with the commission before the
3535 effective date of this Act is governed by the law in effect on the
3636 date the petition was filed, and the former law is continued in
3737 effect for that purpose.
3838 SECTION 3. This Act takes effect on the 91st day after the
3939 last day of the legislative session.
