55 AN ACT
66 relating to electronic voter registration.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 13, Election Code, is
99 amended by adding Section 13.009 to read as follows:
1010 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1111 secretary of state shall work with the Department of Public Safety
1212 and the Department of Information Resources to implement a program
1313 to allow a person to complete a voter registration application over
1414 the Internet from the official website of this state. The Internet
1515 websites of the secretary of state and the Department of Public
1616 Safety must also provide a link to the location of the application
1717 on the official website of this state.
1818 (b) An applicant for electronic voter registration who has
1919 an unexpired driver's license or personal identification card
2020 issued in this state must:
2121 (1) attest to the truth of the information provided on
2222 the application by affirmatively accepting the information as true;
2323 and
2424 (2) affirmatively consent to the use of the signature
2525 on the applicant's driver's license or personal identification card
2626 for voter registration purposes.
2727 (c) An applicant for electronic voter registration who does
2828 not have an unexpired driver's license or personal identification
2929 card issued in this state must:
3030 (1) attest to the truth of the information provided on
3131 the application by affirmatively accepting the information as true;
3232 and
3333 (2) digitally sign the applicant's application before
3434 submitting it electronically.
3535 (d) For each application submitted under Subsection (b),
3636 the program shall require that a digital copy of the applicant's
3737 signature be obtained from the Department of Public Safety.
3838 (e) A digital signature given as provided by secretary of
3939 state rule meets the signature requirement under Section 13.002(b).
4040 An application submitted under this section is considered for all
4141 purposes an application submitted by mail under this title.
4242 (f) The secretary of state shall adopt rules as necessary to
4343 implement this section, including rules to provide for additional
4444 security measures necessary to ensure the accuracy and integrity of
4545 applications submitted electronically.
4646 (g) The rules adopted under Subsection (f) must require
4747 that:
4848 (1) the Internet website through which a person may
4949 complete a voter registration application include a description of
5050 the offense described by Section 13.007 in a conspicuous location
5151 on the website near the place where the person begins or submits the
5252 application; and
5353 (2) the state electronic Internet portal project be
5454 used to authenticate the identity and address of a person who
5555 submits an application electronically under this section.
5656 SECTION 2. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect on the 91st day after the last day of the
6161 legislative session.
