| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter L, Chapter 264, Family Code, is |

| 10 | 10 | | amended by adding Section 264.908 to read as follows: |

| 11 | 11 | | Sec. 264.908. USE OF PARENTAL CHILD SAFETY PLACEMENTS. (a) |
|---|
| 12 | 12 | | Notwithstanding other law, the department shall use a parental |
|---|
| 13 | 13 | | child safety placement in each case in which the department |
|---|
| 14 | 14 | | determines it is appropriate. |
|---|
| 15 | 15 | | (b) If the department determines that a parental child |
|---|
| 16 | 16 | | safety placement is not appropriate, the department shall record in |
|---|
| 17 | 17 | | writing in the child's case file the reasons the department |
|---|
| 18 | 18 | | determined a parental child safety placement was not appropriate. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect on the 91st day after the |
|---|
| 20 | 20 | | last day of the legislative session. |
