44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the establishment of the School Psychologists Shortage
77 Task Force.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. DEFINITIONS. In this Act:
1010 (1) "Commissioner" means the commissioner of
1111 education.
1212 (2) "Task force" means the School Psychologists
1313 Shortage Task Force established under Section 2 of this Act.
1414 SECTION 2. SCHOOL PSYCHOLOGISTS SHORTAGE TASK FORCE. (a)
1515 The commissioner shall establish the School Psychologists Shortage
1616 Task Force to study issues related to the shortage of school
1717 psychologists.
1818 (b) The members of the task force must include:
1919 (1) three members appointed by the lieutenant governor
2020 as follows:
2121 (A) two members of the senate; and
2222 (B) one licensed specialist in school
2323 psychology;
2424 (2) three members appointed by the speaker of the
2525 house of representatives as follows:
2626 (A) two members of the house of representatives;
2727 and
2828 (B) one licensed specialist in school
2929 psychology; and
3030 (3) one member of the State Board of Education
3131 appointed by the commissioner.
3232 (c) The Texas Education Agency shall provide administrative
3333 support to the task force.
3434 (d) The commissioner shall appoint a member of the task
3535 force to serve as the presiding officer.
3636 (e) The task force shall meet at the call of the presiding
3737 officer.
3838 (f) The task force shall:
3939 (1) conduct a study on the issues related to the
4040 shortage of school psychologists among school districts, including
4141 supply and demand issues for school-based psychological services
4242 among districts; and
4343 (2) provide recommendations for increasing the
4444 presence of school psychologists in school districts and increasing
4545 the use of school-based psychological services, as needed.
4646 SECTION 3. REPORT. Not later than December 31, 2024, the
4747 task force shall submit a report to the governor and the legislature
4848 that includes the task force's findings and recommendations under
4949 this Act.
5050 SECTION 4. ABOLITION OF TASK FORCE; EXPIRATION. The task
5151 force is abolished and this Act expires January 1, 2026.
5252 SECTION 5. EFFECTIVE DATE. This Act takes effect
5353 immediately if it receives a vote of two-thirds of all the members
5454 elected to each house, as provided by Section 39, Article III, Texas
5555 Constitution. If this Act does not receive the vote necessary for
5656 immediate effect, this Act takes effect on the 91st day after the
5757 last day of the legislative session.
