55 AN ACT
66 relating to improvements to the Texas Information and Referral
77 Network.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 531.0312, Government Code, is amended by
1010 amending Subsection (a) and adding Subsections (f) and (g) to read
1111 as follows:
1212 (a) The Texas Information and Referral Network at the
1313 commission is the program responsible for the development,
1414 coordination, and implementation of a statewide information and
1515 referral network that integrates existing community-based
1616 structures with state and local agencies. The network must:
1717 (1) include information relating to transportation
1818 services provided to clients of state and local agencies;
1919 (2) be capable of assisting with statewide disaster
2020 response and emergency management, including through the use of
2121 interstate agreements with out-of-state call centers to ensure
2222 preparedness and responsiveness;
2323 (3) include technology capable of communicating with
2424 clients of state and local agencies using one-way and two-way
2525 electronic text messaging to:
2626 (A) enhance client access to information and
2727 referral services;
2828 (B) decrease client wait times;
2929 (C) improve customer service; and
3030 (D) disseminate information to clients in a
3131 timely manner; [and]
3232 (4) include a publicly accessible Internet-based
3333 system to provide real-time, searchable data about [the location
3434 and number of] clients of state and local agencies using the system,
3535 including:
3636 (A) the number of clients;
3737 (B) the location of clients;
3838 (C) [and] the types of requests made by [the]
3939 clients; and
4040 (D) aggregated, de-identified demographic
4141 information regarding the clients and client households served by
4242 the network, including, if the information is volunteered by the
4343 clients after the clients have been given an opportunity to provide
4444 informed and explicit consent:
4545 (i) the gender, race, and ethnicity of each
4646 client; and
4747 (ii) whether the client or a member of the
4848 client's household is:
4949 (a) a veteran;
5050 (b) involved in the criminal justice
5151 system;
5252 (c) pregnant; or
5353 (d) the caregiver to a child who is
5454 five years of age or younger or a kinship caregiver;
5555 (5) use a standardized screening tool to identify the
5656 nonmedical drivers of health for all clients who provide informed
5757 and explicit consent to be screened using the screening tool;
5858 (6) provide enhanced navigation services under a level
5959 of care three (LOC-3) as prescribed by the Department of State
6060 Health Services' Texas Resilience and Recovery Utilization
6161 Management Guidelines in order to:
6262 (A) better address complex client needs; and
6363 (B) collaborate with community partners;
6464 (7) be capable of providing closed-loop referrals to
6565 support clients and track referral outcomes;
6666 (8) exchange resource data with external partners,
6767 including vendors, through data sharing agreements for the purposes
6868 of:
6969 (A) connecting clients to a requested service;
7070 (B) addressing nonmedical drivers of health; and
7171 (C) decreasing redundancies in the health and
7272 human services system;
7373 (9) comply with all applicable state and federal laws
7474 relating to protecting the privacy of each client's health and
7575 personal information, including the Health Insurance Portability
7676 and Accountability Act of 1996 (42 U.S.C. Section 1320d et seq.);
7777 (10) be part of a national repository of information
7878 and referral programs and services that provides the most updated
7979 information about programs and services available at the local,
8080 regional, state, and national levels; and
8181 (11) be capable of providing backup information and
8282 referrals during a statewide disaster or system malfunction.
8383 (f) Health care systems and managed care organizations may
8484 partner and enter into agreements with the commission and area
8585 information centers to share data using the Texas Information and
8686 Referral Network to:
8787 (1) facilitate client care coordination; and
8888 (2) address nonmedical drivers of health, including
8989 housing, transportation, food, and financial assistance programs.
9090 (g) Not later than December 31 of each even-numbered year,
9191 the commission shall:
9292 (1) prepare and submit a report to the governor, the
9393 lieutenant governor, and the speaker of the house of
9494 representatives that:
9595 (A) summarizes the Texas Information and
9696 Referral Network's operations, including the effectiveness of the
9797 network and any improvements made to the network, during the
9898 preceding two state fiscal years;
9999 (B) identifies existing needs and gaps in
100100 services in communities in this state that could be addressed
101101 through additional improvements to the network; and
102102 (C) provides recommendations for improving the
103103 network, including recommendations for improving data privacy and
104104 client experience; and
105105 (2) make the report publicly available on:
106106 (A) the commission's Internet website; and
107107 (B) the Texas Information and Referral Network
108108 Internet site established under Section 531.0313.
109109 SECTION 2. Subchapter B, Chapter 531, Government Code, is
110110 amended by adding Section 531.03121 to read as follows:
111111 Sec. 531.03121. AREA INFORMATION CENTERS: ACCREDITATION
112112 REQUIRED. An area information center that contracts with the
113113 commission to provide Texas Information and Referral Network
114114 operations must be accredited by a nationally recognized
115115 accreditation organization.
116116 SECTION 3. Sections 531.0313(a) and (b), Government Code,
117117 are amended to read as follows:
118118 (a) The Texas Information and Referral Network may develop
119119 an Internet site to provide information to the public regarding the
120120 health and human services provided by public or private entities
121121 throughout the state. An Internet site developed under this
122122 section must be user-friendly and regularly updated to ensure the
123123 Internet site's interface supports the navigation needs of the
124124 site's users.
125125 (b) The material in the Texas Information and Referral
126126 Network Internet site must be:
127127 (1) geographically indexed and designed to inform an
128128 individual about the health and human services provided in the area
129129 where the individual lives;[. The material must be]
130130 (2) further indexed by type of service provided within
131131 each geographic area; and
132132 (3) organized in such a way that the public can search
133133 and navigate through the Internet site with ease.
134134 SECTION 4. If before implementing any provision of this Act
135135 a state agency determines that a waiver or authorization from a
136136 federal agency is necessary for implementation of that provision,
137137 the agency affected by the provision shall request the waiver or
138138 authorization and may delay implementing that provision until the
139139 waiver or authorization is granted.
140140 SECTION 5. This Act takes effect immediately if it receives
141141 a vote of two-thirds of all the members elected to each house, as
142142 provided by Section 39, Article III, Texas Constitution. If this
143143 Act does not receive the vote necessary for immediate effect, this
144144 Act takes effect on the 91st day after the last day of the
145145 legislative session.
